Judicial Inquiry Ordered Against Malik Riaz of Bahria Town

A Supreme Court bench headed by Chief Justice Iftikhar Mohammad Chaudhry has ordered the District and Session Judges Islamabad to launch a judicial inquiry against Malik Riaz on allegations of land grabbing through coercive and blackmailing tactics and submit report to the Supreme Court by 26th November 2009. The DCO Islamabad has also been directed to facilitate and cooperate with the District and Sessions Judge in this regard.

The Supreme Court also ordered the local Police authority to add name of Malik Riaz in supplementary report of the main FIR launched in the murder case of Fayyaz Ahmed (DHA security guard) after the statement of his widow in the courtroom.

Malik Riaz - Land Grabbing Mafia

Malik Riaz of Bahria Towns property empire in Pakistan and has been closely associated with both General Musharraf and Asif Ali Zardari and is known to be the richest person in Pakistan.

It all started with a Suo moto action of Supreme Court against some appeals published by the name of Raja Riasat claiming that his son Fayyaz Ahmed (DHA Security Guard) was murdered nearly a year ago and his alleged murderer Shafiq-ur-Rehman, the owner of Allied Developers, was released by the court on bail.

The Supreme Court hearing on this subject was held on 26th and 27th October 2009. On the first day of hearing, lawyer of Shafiq-ur-Rehman (Justice (R) Tariq Mahmood), lawyer of Raja Riasat (Malik Waheed Anjum), brother of murdered guard, Mr. Tahir and his widow Shamriza Bibi appeared before the court.

The story got a shocking twist right form the start of hearing when Chief Justice asked about Raja Riasat whose name was appearing in the newspaper appeals and which was the main reason of this suo moto action. It was revealed by brother of murdered guard that Raja Riasat, his father, had passed way and he or his family had no idea who was behind the publishing these appeals in newspapers in the name of his father. It was then revealed that in fact it is Malik Riaz who financed publishing of these appeals for his own motives.

Lawyer of Shafiq-ur-Rehman (Jusitice (R) Tariq Mahmood) told the court that in fact name of his client was added in these fabricated appeals by Malik Riaz because he wanted to grab land of his client for his Bahria Town on GT Road. When Shafiq-ur-Rehman refused to do so, Malik Riaz, being a very influential person of Pakistani elite, got Shafiq-ur-Rehman name added to murder case of Fayyaz Ahmed. Later, when Shafiqu-ur-Rehman was released on bail, Malik Riaz decided to use blackmailing tactics through this appeal in newspapers.

Later when court asked the widow of Fayyaz Ahmed to name the suspect in murder of her husband, she categorically named Malik Riaz of Bahria Town. She recorded her official statement in this regard against Malik Riaz and Chief Justice asked the local police officer to add this statement and hence name of Malik Riaz to supplementary reports of FIR of this case.

It was also revealed in the court that another businessman Malik Tabarak Hussain, aka Malik Bari tried to help the widow and other victims of similar coercive tactics of Malik Riaz of land grabbing. Malik Bari had also planned to bring many of such victims to court but Malik Riaz used his influence to get Malik Bari arrested through Sindh Police and later he was taken to Karachi by Sindh Police. The Supreme Court ordered the Sindh Police authorities to produce Malik Bari in the court on next hearing (Tuesday, 27 Oct 09). Some other people also claimed in the court that they are victims of Malik Riaz's land mafia. They told the court their specific stories in this regard.

The Supreme Court then ordered the District and Sessions Judge Islamabad to launch a judicial inquiry in this matter and submit report by 26th November 2009.

On the 2nd day hearing (27th October 2009), Malik Bari was produced in the court and court observed that cases against Malik Bari are all fabricated and also Sindh Police has not followed the standard procedures in this regard. Malik Bari was later released on bail. It was also claimed in the court that airline tickets of Sindh Police taking Malik Bari to Karachi had been paid by Malik Riaz. Interestingly, Barrister Akram Sheikh represented Malik Riaz in the Court.

The Supreme Court has referred all victims of Malik Riaz including Malik Bari, Shafiq-ur-Rehman and many others to approach District and Sessions Judge Islamabad, who has been given the task for judicial inquiry of these land-grabbing cases.

    Seems like most people know everything that politicians do even when they have not done it, but know very little about the influential businessmen who control so much in our country.

    Malik Tabarak alias Malik Bari, though not an angel himself, is someone who dared to stand up to the biggest real estate tycoon and land grabber Malik Riaz. Bari is a big land owner who is sort of a "danday mar" himself and is known to have a large ego. When Malik Riaz started his land mafia, Bahria town, he was the one resisting the land grab. Most of the poor people whose land was forcibly occupied by Malik Riaz's goons ran to Bari for help and thats how his tussle with Malik Riaz started.

    Incidentally, Malik Riaz is an interesting character himself. He arrived in pindi from sialkot in 1970s as a an uneducated poor person and was known only as Riaz Hussain at the time. He became rich and malik simultaneously. He initially tried his luck as small time contractor. His luck changed when he became a military stores supplier (no surprise). There he got cozy with the corrupt military men. This led to the start of Bahria Town for which the very "honest" Admiral Mansoor ul Haq allowed the use of Bahria name.

    His initial land grab was mostly on shamilat and punjab govt land. Later on as bahria town expanded, he recruited a force of "ghundas" from punjab (most of whom are proclaimed offenders having committed many murders) and started grabbing land of those people who refused too sell to his agents at low prices. His ghundas are known too have committed several murders in the area.

    Malik Riaz was very close to musharraf and also financed Shaukat Aziz's bye-election campaign from attock. Now he is buddy-buddy with zardari and he was the one in Nawaz-Zardari meeting in august who suggested that zardari would take oath on Quran. These days many people go through him if they need any favour from zardari.

    Malik Riaz was also dead against restoration of judiciary. The reason is that during mush regime, he wanted to develop a sector of Bahria town in haripur across margalla hills and suggested construction of tunnel in margalla hills to connect that sector with Islamabad. Mush had approved that project but supreme court stopped it on the grounds that Margalla Hills area is a protected national park. Since then he is always speaking against the supreme court judges and it is said that he was one of those advising zardari against restoring independent judges.

    Interestingly, I have not seen any newspaper giving Malik Riaz's name in this story. Some have not printed the story at all. Others only mention that supreme court ordered registration of a case against a real estate developer. Seems like our "independent" media is independent only when it talks against politicians. It loses its independence for the fear of losing lucrative advertisement revenue when the news is about business barons.

    This Chamat deserves Kal Kothri more than any politician as he finance them, in fact invest in them to gain favors.

    Wonder what Akram Sheikh will comment for defending this Don. I guess he must have forgotton all Qurani Taileems, which he preaches in all his TV appreances when reciving a hefty fee.

    The lawyer Akram Sheikh is notorious of taking extremely lucrative land grabbing cases. City of Faisalabad is besieged to expand one of it's main artery, Railway Road, into the eight bazaars of Clock Tower. The Railway Road has been encroached by businesses since several decades. The Railway Road merchant association hired this high power lawyer with a going price of Rupee ten million (one Krore).

    Our wonderful justice system has issued him a stay-order on the litigation since several years while the land grabbers are busy in building high-rise plazas on public land.

    This is why we all supported the lawyers movement and the CJ. All the people who gave their lives for that and the ones who were burnet alive in Karachi by the MQM commandos, which Mush-Haram took credit for their spitrts in haven must be proud that their sacrifice for their country was worth it. I am hoping that one by one all these criminals, including the Family, religious and political ethnic Mafia bosses will be brought to justice. May the people of Pakistan who have given their lives for the best interest of their countrymen rest in peace.

    don't forget that CJ himself pointed out about corruption in Judiciary. Who knows that this session judge is not among the black sheeps of judiciary.

    One thing that I heard long time ago when I lived in Lahore is that Shebaz Sharif was the big boss of all land mafia groups in lahore. Does any one know anything about this or this is just a propaganda?

    Though Navy doesnt have anything officially to do with Bharia Town now, but still many of the top officers of Bahria town are former navy. Malik Riaz has been very shrewd in cultivating relations with the elite of the country. Right from the beginning, he brought military brass on his side by doling out plots at throw away rates. Then he repeated the same with govt officials. In return, everyone looked the other way when he was allegedly occupying government land or threatening and intimidating ing private citizens who refused to part with their land voluntarily.

    He also takes good care to keep a positive public profile through his free dispensary and free food for poor. A few years back he also dabbed into journalism and owns Daily Jinnah.

    He was very close to Musharraf and is very close now to Zardari. I guess he will also become very close to whoever next comes into power. Businessmen like him and Iqbal Z Ahmed are very adept in these things.

    When direction comes from top and the civil judge knows that Big Brother is looking over the shoulder, then very little chance of a soft report. However if the civil judge prefers one hefty brief case, that will be his choice but even then he will not be ablt to hide all evils.

    This Chamat should be made an example and also a few columists who are presenting him as Robin Hood, detailing the money he has given to poor people and relief funds. It would have been nice if the stated the amount they recieved to write these columns.

    Has this gentleman, called Malik Riaz, been given a chance to defend himself? I am sure, not.
    We all are fond of giving examples of the law in USA/UK where a person is ' believed to be innocent unless proved guilty' but here we find everybody critisizing another person, left, right & center, by hiding behind veils.
    I am sure if those critisizing that 'tycoon' were ever to go to a court of law to challenge him, then I am 100% sure that his critics will face an ignoble defeat.
    I feel that his critics want a 'piece' of his worth of 'U.S$ 1.5 billon' which according to them, he is supposed to own. But even if his critics were to take their own share out of his hard-earned money, like 'thieves in the broad day-light' then I am sure they would still 'want more' of his money.
    To critize from far distant is a very easy task, especially when the antecedents of his critics are not known.
    Lets not criticize those who cannot defend themselves here in these columns, especially by those people who hide their real names & indicate only false/assumed user-names, ONLY TO BE COUNTED, as contributors to these columns.
    But those who are brave at heart & do not have 'feet of clay' should show 'real guts' & face Malik Riaz to challenge him openly in any court of law, by bringing his 'wrong-doings' in the open.
    IF they cannot do so, then they should term themselves as 'BIG FAILURES' in their own lives.
    They should also allow themselves to be termed as 'BIG COWARDS.'
    Yes as pure cowards; nothing less & nothing more.
    Because then it is the 'BAD LUCK' of his critics that they do not have the equivalent of 'billons of U.S dollors' that he, i.e; Malik Riaz is supposed to possess.
    (Mind you, I neither know Malik Riaz nor I ever met him.) But I only ask of his critics to be honest & ONLY fear Allah & not to criticize only for criticism's sake.
    Does anybody know, over all these years, how hard has he worked to reach the enviable position that he is placed today?
    Lets not be jealous of him, but lets us praise him as the most able of any of the administrators of a housing scheme today that Pakistan has produced.

I am sure admin of this site is not hiding his ID here and doesnt need to be revealed again. and as per your wish supreme court has already asked people to report to District and Session judges if they have anything to say. So hopefully people will show up surely with their IDs along with their stories. we got to wait what comes up out of this.

This does not mean that every person who is related to this business is a fraud and Malik Riaz should be given a chance to defend him.     Well now you have a case against him in court. Names and other details of such people must be available in court. Nevertheless, in a country like Pakistan Ordinary people can't defend themselves even against an Ordinary police officer like ASI or SHO. How can you expect people to come out in open aginst a person who has substantial influence in Pakistan. However, modren technology has given an opportunity to people to raise their voice against anybody.

    I am sure that Sabzbagh is not your real name. I have never heard such a name. You are blaming people of what you are doing yourself.

    It is hard to understand why you are defending him. You mentioned that you neither know Malik Riaz nor you ever met him. Then why you are defending him. Either you are associated with him or you have been benifited by him or you honestly believe that he is a gentleman. If you believe that he is a gentleman you must have some reason to believe that. But then again you say that you don't know him, in that case how you can honestly believe that he is a gentleman.

    May Allah help Malik Riaz and exalt him if he is gentleman and is being victimized for some reason. If he is a goon and has been cruel to innocent people then Allah's punishment is severe. Allah knows the best.
