Re: Federal Appeals Courts bows down to Islam, upholds ruling blocking the implementation of an Oklahoma amendment banning Sharia Law

Jewish groups mobilize against anti-sharia bills that would also bar
arbitration under Jewish religious law

BY JUSTIN ELLIOTT

We're a bit late to this one, but Ron Kampeas of JTA has a fascinating
recent piece on fears that anti-sharia initiatives brewing around the
country could also threaten observance of traditional Jewish law, or
halachah.

You don't hear much about halachah, or rabbinical courts known as beit
din, even though both have been a feature of observant American Jewish
communities for years.

But some Jewish groups are now lobbying against anti-sharia bills that
have been drafted — possibly as a way to preempt constitutional
challenges — to bar any and all foreign or religious law in U.S.
courts, not just sharia:

"The laws are not identical, but as a general rule they could be
interpreted broadly to prevent two Jewish litigants from going to a
beit din," a Jewish religious court, said Abba Cohen, the Washington
director of Agudath Israel of America, an Orthodox umbrella group.
"That would be a terrible infringement on our religious freedom."

A number of recent beit din arbitrations that were taken by
litigants to civil courts — on whether a batch of etrogim met kosher
standards; on whether a teacher at a yeshiva was rightfully dismissed;
and on the ownership of Torah scrolls — would have no standing under
the proposed laws.

A spokesman for the Orthodox Union explained that a prohibition on
religious law would be a problem in situations when Jewish law comes
up in civil courts:

Such laws "are problematic particularly from the perspective of
the Orthodox community — we have a beit din system, Jews have disputes
resolved according to halachah," Diament said. "We don't have our own
police force, and the mechanism for having those decisions enforced if
they need to be enforced is the way any private arbitration is
enforced" — through contract law in the secular court system.

Some prominent Jewish groups seem to be putting some real lobbying
muscle into this issue in state legislatures, so it will be
interesting to see what happens.

NFL Announces New 82-Game Regular Season

CAP News
NFL Announces New 82-Game Regular Season
NFL Announces New 82-Game Regular Season
NFL Commissioner Roger Goodell discusses the league's new "Play 82" initiative.

CANTON, Ohio (CAP) - In an announcement that is sending shockwaves throughout the sporting world, NFL Commissioner Roger Gooddell has laid out plans to increase the length of the league's regular season from a 16-game weekly schedule to an 82-game schedule in which teams will be expected to play several games each week.

"There's been talk of adding games to the season for some time," explained Goodell during a press conference to explain the change. "We just added more than most people expected."

The 82-game regular season format, already in place in both the National Basketball Association and the National Hockey League, will require the 32 teams of the NFL to each play 41 games at home and 41 games away. According to Goodell, the postseason format for the league will also change.

"We're going to the best of seven series structure, including the championship, or Super Bowl, series," he announced. "Meaning that in the playoffs, a team might play up to 21 additional games each year. Whoever wins the Super Bowl Series next year will have to play at least 96 games."

When asked why the League thought these changes were necessary, Goodell was quick to point to the growing ratings competition from other sports.

"Those other leagues have the right idea. They saturate the market with their product to win fans," Goodell said with an almost tangible sense of annoyance. "I mean, would you even know what hockey was if it was only played one day a week?"

With the league's bottom line being to capture the majority of future airtime, Goodell said additional changes were needed as well. A team's roster, which currently allows a maximum of 53 players, with a maximum of 45 dressed to play each week, will be expanded to 388 players, with up to 310 dressed to play each week.

Health issues for players became a hot topic among media personnel present at the news conference, but Goodell was quick to rebutt these concerns.

"Look, those guys in the NHL are hitting each other all the time," defended Goodell. "It's not like they're out there dying on the ice or something. It's sports. It's supposed to be physical. I think we're going to prove that we have the best, toughest guys around."

Despite these assertations, pundits agree that the number of injuries in the league will skyrocket.

"We're looking at seeing traumatic injuries in just about every game," argues Dr. Amit Singh, a respected Los Angeles sports surgeon. "I can't imagine the careers of these athletes lasting more than a few seasons."

For his part, Goodell has dismissed such claims as "absurd" and "alarmist," stating that "these athletes are good to go."

Despite the concerns of the medical community, the extended season will move forward as scheduled, with games nearly everyday from the season opener in September until whatever date a team is able to emerge victorious from the newly expanded playoffs. Meanwhile, major and minor television networks alike are already planning to preempt basketball and hockey games in favor of broadcasts from the gridiron.

Obama Decrees Congress Irrelevant

From: levant marvin [mailto:levantm@shaw.ca]
Sent: Monday, January 09, 2012 9:11 PM
Subject: Obama Decrees Congress Irrelevant

It's Official: Barack Obama Has Declared Himself De-facto Dictator Of The United States Of America.

While the tyrannical pronouncement went largely unreported by the Obama-media, Barack Obama declared himself de-facto dictator of the United States of America on Wednesday, possibly signaling the end of the United States as we know it.

In what can only be described as a blatant, totalitarian and authoritarian abuse of power, Barack Obama, decreed that Richard Cordray would be the head of his so-called Consumer Financial Protection Bureau, and hemade his declaration without the advice and consent of the Senate, and, by doing so, he clearly violated Article 2, Section 2 of the United States Constitution

But do not be deceived, the Cordray decree is not just another run of the mill Obama abuse of power.

Through this seemingly insignificant but illegal act of defiance, Barack Obama stopped sticking his toe in the water and finally took the plunge and declared Congress irrelevant, and as long as Congress accepts its newly decreed irrelevance, nothing stands in Barack Obama's way. That's how tyrannies start!

We can't allow that to happen.  The disease that is the Obama administration must be stopped and IMPEACHMENT is the only cure

They Puff. They Pontificate. And Yet, They Do Nothing!

There's no doubt that Obama, by any sane person's reckoning, has crossed the line. And yet, our elected officials are still all talk and no action.  What gives?

After blustering and pontificating that Obama's actions were "an extraordinary and entirely unprecedented power grab" that "would have a devastating effect on the checks and balances that are enshrined in our Constitution," John Boehner cowardly rolled over and said; "I expect the courts will find the appointment to be illegitimate."

Excuse us Mr. Boehner? Wait just a minute. The Constitution is clear and your Constitutional duty is clear. And simply talking tough and punting your Constitutional duty over to liberal activist judges does not excuse you from doing your duty.

Barack Obama is not a king or a monarch. He is not our dictator and when the man or woman occupying the Oval Office violates the Constitution, the remedy is IMPEACHMENT and the jurisdiction to impeach lies with you, not the courts

Mitch McConnell did no better. All he could muster was feckless outrage and say that Obama had "arrogantly circumvented the American people" and his decree"fundamentally endangers the Congress's role in providing a check on the excesses of the executive branch."

     Just words... nothing but words.

But make no mistake, our founding fathers are rolling over in their graves over this dictatorial and tyrannical power grab and we are once again left to ask: What must this pretender do... how many times must this tin-pot dictator abuse the Constitution before our elected officials do what must be done to preserve our Republic and push to impeach this imposter and remove him from the office that he usurped

The Media Is Lying To You. Cordray Was Not A "Recess Appointment" And Obama Knows That He Is Violating The Constitution.

You may be asking yourself: Did Obama blatantly violate the Constitution? Isn't the President allowed to make recess appointments when the Senate in not in session?

You might also be asking, didn't President George W. Bush appoint John Bolton as Ambassador to the United Nations as a recess appointment?

The answer to all those questions is an unqualified yes, but what the media is neglecting to tell you is that the Senate IS NOT IN RECESS

The Senate IS NOT in recess because on December 17, Harry Reid's Senate agreed to an order instituting what are called "pro forma sessions" so that Senate business can move forward during the holidays.

And, in spite of what the media may be telling you, these pro forma sessions are not unprecedented (in fact, they're quite common) and they're not mere technicalities, as Obama's apologists would have you believe.

Oh yes, they'd like you to believe that Barack Obama has the authority to do exactly what the Constitution so expressly prohibits. Communications Director Dan Pfeiffer went so far as to LIE and call the pro forma sessions a "gimmick" and added that "gimmicks do not override the President's constitutional authority to make appointments."

But Barack Obama KNOWS the pro forma sessions are no "gimmick" and he knows what should be apparent to any five year-old... that he has no Constitutional authority to violate the Constitution and make recess appointments when the Senate IS NOT in recess.

And if you're looking for proof, look no further than the so-called "payroll tax cut extension" that Obama recently signed into law on December 23.

As Andrew Grossman of the Heritage Foundation points out, "it was at one of those [pro forma] sessions, on December 23, that the Senate passed the payroll tax cut extension that the President signed into law later that day."

Yup, Obama Was For The Senate Being In Session Before He Was Against The Senate Being In Session.

So how did Barack Obama sign a bill into law that was passed by a Senate that was in recess? Answer: he didn't... he couldn't... it's impossible.

Obama knew that the Senate was in session when he signed his so-called"payroll tax cut extension" into law. So how can he dictatorially decree, days later, that the Senate WAS NOT in session when he appointed Cordray?

He can't! Barack Obama DOES NOT have the power to declare when the SenateIS or IS NOT in session (even legitimate Presidents don't have that authority... Article 5, Section 1 of the Constitution expressly forbids it). In spite of what he may think, he IS NOT a king... he IS NOT a dictator!

As Edwin Meese and Todd Gaziano, in a commentary published by the liberalWashington Post point out: "[N]ever before has a president purported to make a 'recess' appointment when the Senate is demonstrably not in recess. That is a constitutional abuse of a high order." [Emphasis Ours]

And Meese and Gaziano add: "To prevent future tyrannical usurpations of power, Congress must act to redress this serious threat to our liberty."

Did you hear that Mr. Boehner? ... Mr. McConnell? ... "Congress must act." And the only reason why Barack Obama is getting away with this dictatorial abuse of power is because our so-called "leaders" in Congress are too cowardly to act, andit's up to us to give them some much-needed backbone

If they don't stand up to Obama, what's next? Will Obama decree next year that the 2012 elections should be postponed or declared null and void? Will the media then tell us that he has the Constitutional power to do so?

And if you doubt that the above scenario can happen, ask yourself the following question: If Congress allows Obama to get away with this latest tyrannical usurpation of power, will more tyrannical abuses of power follow... each more egregious and far reaching than the previous?

We agree with Meese and Gaziano. "Congress must act to redress this serious threat to our liberty," and the only fitting Constitutional remedy for a "tyrannical usurpation of power" is IMPEACHMENT

Obama Has Not Even Tried To Conceal The Fact That He Considers Himself To Be A Dictator.

Let's face facts; tyranny has become a pattern of behavior with Obama and he's no longer making an effort to even conceal his tyrannical abuses of power.

When it comes to the Cordray appointment, the Wall Street Journal writes:

"[A]dministration officials say they reserve the option to install Richard Cordray as head of the new Consumer Financial Protection Bureau without Senate approval. That's because the White House has concluded that it can make the appointment even if the Senate has not formally recessed, said one Democrat familiar with White House thinking. 'They have decided no one can stop them.'" [Emphasis Ours]

You read that right, Obama has essentially said... I'll do as I please and I dare anyone to stop me (it's high time for Mr. Boehner and Mr. McConnell to take him up on that dare)

Gaziano cautions us that Cordray's appointment is "a grave constitutional wrong" that "fits a pattern of extra-constitutional abuse by the White House."

Even one of Barack Obama's advisers, Josh Earnest has boasted, bold as brass, that working with Congress is "no longer a requirement."

And why shouldn't Obama and his apparatchiks be bold? At every turn our so-called Republican leaders in Congress have given him inches, and each time he has taken miles. When will these tyrannical abuses stop? How far will Barack Obama go? When will they draw a line in the sand and say: the tyranny stops today

History doesn't paint a pretty picture. Until patriotic Americans take action and lean on our elected representatives to expose Obama's dictatorial, illegal and unconstitutional behavior, the sky is the limit

And to those who may be saying that pushing for impeachment is "impractical"with an election less than year away, we respectfully ask: how much damage can Barack Obama do in one year? How much power can he tyrannically usurp in a year? How much damage can he do to this great country and our Constitution in a year

Pending elections DO NOT trump the Constitution and at this point, patrioticAmericans should not be asking whether Barack Obama should be impeached but rather, need to be asking WHEN will Barack Obama be impeached

Top Five Defense Moves for 2012

Tuesday, 10 January 2012 06:17 James Jay Carafano, Ph.D.

Iran is rattling sabers. Iraq may be falling apart. In North Korea, one of the world's most inexperienced and unpredictable leaders has his thumb on the country's nuclear button. Talks with the Taliban look like an instant replay of the Paris peace negotiations with Hanoi. The Arab Spring has turned into a long winter of discontent. Now is not the time to be gutting defense.

Yet the Secretary of Defense is poised to announce a new strategy that will rubber stamp massive military cuts, pulling the safety net out from a global security architecture that has protected U.S. vital interests worldwide since 1945. The Obama Administration's strategy by wishful thinking will not be sufficient to keep the nation safe, free, and prosperous in the year ahead. Rather, Congress and the White House should be making bold moves to restore America's capacity to protect itself. Here are the top five they could make.

1. Own the Skies

Rather than slowing production of the F-35—America's newest combat aircraft, which can replace upwards of a dozen airframes that do a variety of missions from reconnaissance to attacking targets—the Pentagon ought to be ramping up production. It is time to reap the benefits of the $50 billion taxpayer investment in this program. Likewise, the Pentagon should reopen the recently canceled F-22 production, the companion stealth fighter for the F-35. The two planes were designed to work together to give the U.S. the capacity to maintain air supremacy in any theater for decades.

At the same time, the government should be aggressively seeking to export both planes to any capable ally. In particular, the goal ought to be to ring the Asia-Pacific from India to the Arctic with a robust allied air fleet of F-35/F-22 fighters.

2. Build Ships Faster

The U.S. has the smallest Navy since before World War I. While it is true that modern ships are much more capable than their predecessors, the planet is the same size. When U.S. presence is absent for critical areas, as was recently seen in the Strait of Hormuz—trouble follows. From submarines to amphibious ships to carriers, the U.S. needs to ramp up production.

The needs also go beyond the Defense Department. Replacing the Coast Guard's aging fleet of ships continues to lag, undermining the capacity of the U.S. to protect its sovereignty at sea. In particular, replacing the Coast Guard (part of the Department of Homeland Security) fleet of "high-endurance" cutters has to be a priority.

3. Do Not Cut Ground Forces

Human capital is the most valuable resource in the armed forces. Shedding the most qualified, combat-experienced, volunteer ground forces in the nation's history would be like Apple canceling the production of iPhones to save money. It makes no sense.

The argument that "we won't need these troops because we are not going to do any more Iraqs and Afghanistans" is just a strategy of hope. These were the same arguments used to justify troop cuts before 9/11. As then, the enemy gets a vote, and it always votes to fight the wars that the U.S. is least prepared for. Rebuilding ground forces is far more expensive—and less risky—than maintaining adequate troop strength to defend the nation's interests and deter conflict.

4. Put Missile Defense on the Fast Track

President Obama's "phased and adaptive" missile defense program has proven itself to be insufficient and inadequate. The nation needs immediate and comprehensive missile defense now. That demands starting a three-step process:

1.     Expand and continually improve the Navy's proven and popular sea-based Aegis missile defense system;

2.     Pursue advanced integration of the various components of a layered missile defense system, including ground-based interceptors; and

3.     Develop and deploy space-based missile defenses, particularly space-based interceptors, to counter ballistic missile attacks.

5. Start with Smart Savings

There are savings to be gained from more efficient defense spending, but they should be reinvested in defense modernization. The most immediate source of efficiencies to be gained is in the area of simplifying, consolidating, and contracting defense logistics. Estimates of immediate benefits range up to $90 billion. Congress and the Administration should focus laser-like on this area of Pentagon spending—now.

Really curbing cost growth over time requires getting the cost of manpower under control by establishing a more rational and practical package of pay and benefits for service members and their families. This can be done in a manner that honors commitments to those currently serving and providing more flexible and desirable benefits that would allow the service to continue to recruit and retain a quality all-volunteer force at reasonable cost.

The Wrong Way to Balance the Budget

Gutting defense would not balance the budget. However, it would certainly contribute to making the world less safe for America and its allies and leave the U.S. less prepared to deal with the dangers ahead. The smart move would be to invest in defense—rather than pay the butcher's bill later.
