Louisiana: Cops Beat Up Old Man For Accelerating Slightly

Louisiana: Cops Beat Up Old Man For Accelerating Slightly
Appeals court upholds $25,000 fine on Louisiana police officers who beat an elderly man during a minor traffic stop.

Police in Louisiana slammed a 67-year-old man into the ground, arresting him over a questionable traffic violation. The state court of appeals ruled May 11 that Calvin D. Miller's injuries were only worth $25,000 in compensation. Miller had been driving his big rig logging truck home to Florien on US Highway 171 at 5:30pm on July 13, 2007. As he passed through the Village of Hornbeck, Officers Kenneth Hatchett, Jr., and Andy Mitchell, 19, pulled him over because he began speeding up "about 100 feet" before the limit changed from 45 to 55 MPH. Having driven the road for the past forty-seven years, Miller was quite familiar with the speed limit. He insisted he was not speeding.

"I can see right now you're going to need an attitude adjustment," Officer Hatchett said to the five foot, six inch tall elderly man.

Miller punched his own fist, then turned his back on the officers and began walking away. They threw him to the ground, deliberately slamming his head into the concrete so he could be handcuffed tightly. After Miller's wife bailed him out, Miller went to Byrd Regional Hospital where physicians documented the gash on Miller's forehead, the swelling and bruises and the injury to his wrist and arms. His missed two weeks of work after the incident.

"You don't turn your back on a cop," Officer Hatchett explained.

Both officers denied knowing how Miller's head came into contact with the concrete road shoulder. Eleventh Judicial District Court Judge Stephen Bruce Beasley did not find their testimony credible.

"Officers Hatchett and Mitchell had the considerable advantage of youth, height, weight and weaponry over Miller," Beasley ruled. "There was no testimony that Miller, at any time during the altercation, brandished or was perceived to possess a weapon. Although Miller was attempting to leave the scene, the stop did not require taking him into custody."

Beasley found the officers entirely at fault for Miller's injuries and awarded him $25,000 in damages. The officers appealed the ruling, insisting they had full immunity from prosecution. A three-judge appellate panel rejected the claim and upheld the judgment in full, declining to adjust the damages up or down.

"The totality of the circumstances support the trial court's finding that the two young armed officers faced little or no risks from Miller for his crime of 'speeding' (assuming it to be true) shortly before he actually reached the fifty-five-mile-per-hour sign," Judge Shannon J. Gremillion wrote for the appeals court. "There is no error in the finding that the force used was excessive and not motivated by officer safety, but to adjust Miller's attitude."

Freedom is always illegal!

When we ask for freedom, we have already failed. It is only when we declare freedom for ourselves and refuse to accept any less, that we have any possibility of being free.

Re: Three Arrested, Accused Of Illegally Feeding Homeless

Feeding the homeless is indeed the issue. In early 2006, the Orlando City Council passed an ordinance that prohibits sharing food with more than 25 people in city parks without a permit and limits permitted groups to doing so only two times a year.

That folks such as yourself support such crap is disturbing.

Podcast interview re constitutional evil w/ Dr. Mark A. Graber

Posted this morning at Electric Politics, a podcast interview with Dr.
Mark A. Graber, author of Dred Scott and the Problem of Constitutional
Evil (Cambridge, 2006). Mark points out that the U.S. Constitution
forces us into some difficult choices. Do we acquiesce to evil in
order to preserve the union? Can we persuade those determined to
perpetrate evil to change their ways? Or is political coercion,
outside the framework of the Constitution, a realistic option?

These questions remain relevant today.

As always, if you enjoy the podcast please don't hesitate to forward
the link.

Fatah, Hamas To Collaborate On Rap Album

Fatah and Hamas representatives pause for a photo op with the Palestinian Posse

ANKARA, Turkey (CAP) - Following meetings in Cairo and Gaza City to finalize the terms of a recording deal, Fatah and Hamas officials met in Turkey's capital yesterday to announce that the two groups would be collaborating on a new rap album to be released next month. Proceeds from music downloads will go toward the Gaza Strip Rebeautification Project.

"Nothing brings two disparate groups together like music," said Arab League Secretary General Amr Mousa, who brokered the deal. "Well, except maybe a good Shawarma or Falafel, but the last time we tried a unified recipe book, it just ended with a giant food fight and Hamas taking control of the Gaza Strip.

"Our hope is that instead of hating on each other, both Fatah and Hamas can work together on a shared hatred of Western authority, historical boundaries, and the Po-Po," added Mousa.

World leaders are reacting positively to the news of a music-themed peace approach and are anxious to receive advanced copies. Many are likening it to the 1993 Bloods & Crips album, Banging On Wax, the cooperative effort that came so close to ending gang violence forever had one third of the combined gangs not ended up deceased.

"Only by working together can these two factions ensure a long-lasting peace and sales of 500,000 units," President Obama said at this morning's press briefing. "With that said, the, uhh, second, third and fourth songs are totally dope with fresh beats you can dance to and I can't wait to illegally download the rest of the album."

The album, tentatively titled Peace Out, Palestine, is being penned and performed by local hip hop artists Mahmoudy Moud and the Fatah Bunch, the Sugarhamas Gang and Grandmaster Fatah. Famed Turkish producer DJ Ist N. Bull is overseeing the effort, which is being recorded at the historic Abbas Road studios and will be released on Def Jew Records.

"A lot of blood and sweat has gone into the making of this album," said DJ Bull. "Mostly blood, I guess, as fighting has already broken out three times during recording sessions. Thank Allah for all the guest artists helping else there might not be anybody left."

DJ Bull said the album features guest tracks by Jew-Z (Fatah Gots To Chill), LL Cool Jew (Hamas Said Knock You Out) and DJ Jazzy Jew (Palestinians Just Don't Understand). Other tracks include Nuthin But A "Gaza" Thang, Hamaz N The Hood, and Pop Goes The Peace Accord. And DJ Bull has already lined up the first leg of the group's Straight Outta Cairo tour with stops in Egypt, Israel and Saudi Arabia.

"This is shaping up to be the best rap album from the region since MC Hamas' 1990 CD, Please Hamas Don't Hurt 'Em," said Palestinian hip hop blogger Doug E. Fatah. "This shit is a thousand years of conflict whittled down to 14 kick-ass tracks."

Other early reviews have been extremely positive as well, with Rolling Stone calling it "The Middle East at its unrest best."

If the album sells as well as many think it will, DJ Bull said he's already planning to record a set of contemporary favorites with the two factions to try to reach a wider audience. Early tracks include He Ain't Heavy, He's Hamas; Once, Twice, Three Times A Fatah; and Israel In The Stream.

Ooops! That Cat is Out of the Bag: Media Finally Notices that a Bullet Coated with Pig Fat Killed Osama Bin Laden

Ooops! That Cat is Out of the Bag: Media Finally Notices that a Bullet Coated with Pig Fat Killed Osama Bin Laden

Shhh...  Don't tell Obama, he'll freak out and ban our military from using it:

H/T - Cavmom for telling us about Silver Bullet Gun Oil years ago.

Did a pork-coated bullet kill Bin Laden? Yes, says firm who claim its pig fat gun oil is bought by U.S. military personnel

Daily Mail UK

Was Osama bin Laden shot with a bullet soaked in pork fat, denying him a place in paradise?

Yes, if one rather shady website, that peddles gun oil containing liquefied pig fat, is to be believed.

The makers of Silver Bullet Gun Oil claim it contains 13 per cent USDA liquefied pig fat thus making the product 'a highly effective counter-Islamic terrorist force multiplier.'

The apparent owner of the gun oil site, who goes by the name 'The Midnight Rider,' explains how the pig fat will transfer onto anything the bullet strikes.

This 'effectively denies entry to Allah's paradise to an Islamo-fascist terrorist,' Rider adds.

The oil, which costs $8.95 for 4oz, apparently puts the 'fear of death into them (terrorists)'.

In Islam consumption of pork is forbidden, but the Quran also states that if one is forced to consume the meat then they are guiltless and therefore not disqualified from paradise.

The website also notes its customers include members of the U.S. military.

'Thousands of bottles of Silver Bullet Gun Oil have been distributed since July of 2004 by its creator to members of ALL U.S. Military branches,' it claims.

A promotional YouTube video for the oil shows a picture of Bin Laden and the claim: 'Killed with a weapon using Silver Bullet Gun Oil'.

'Midnite Rider' also known as 'Warrior of YAHWEH,' claims to be a former Marine scout sniper on the site.

Re: Rand Paul Calls For Jailing People Who Attend 'Radical Political Speeches'

I have seen one or two places where people very dishonestly imply that Rand Paul was advocating more government intrusion than we have under Pbama.  I heard him on the radio and he was clearly advocating less.

And ain't that the rub Bruce?

I'm not at all sure I disagree with you at all, but given your caveat,
one (perhaps even I), could make the argument that everyone is
actually better than allowing the government to single out (I'm
thinking Tailgunner Joe, for eg), people/groups.

Ya dig?
