Re: Watch Now: "8" L.A. Premiere: A Play About The Fight for Marriage Equality, Brad Pitt, George Clooney Star

Little Kiethie-

You have not answered my questions, so let me ask it again:

Why don't you watch the play, in it's entirety, before you dismiss
it?
Put aside your personal animus and listen to the arguments carefully.

The transcript of the Prop 8 trial is available on line, and in my
group archives.
It sets an hisstoric legal precident, in that it rules laws and
referenduns against Marrige Equality are both discriminatory and
unconstitutional.

After you watch, let me ask you this. Exactly how does Marriage
Equality "redefine marriage" as you assert?
Please be specific.

Theocratic Republican Church-State: Rick Santorum Isn’t Crazy

Theocratic Republican Church-State

Rick Santorum Isn't Crazy
By STANLEY FISH

Stanley Fish on education, law and society.

church and state, Rick Santorum, Supreme Court

Media pundits have been beating up on Rick Santorum for saying that
the assertion of an absolute separation of church and state makes him
want to throw up, for attacking John F. Kennedy's pledge to be "a
president whose religious views are his own private affair" and for
declaring that "the idea that the church can have no influence in the
operation of the state is absolutely antithetical to the objectives
and visions of our country."

In response, commentators have advised Santorum to read the
Constitution, urged him to become familiar with the pronouncements of
James Madison and Thomas Jefferson and chastised him for "bashing …
the Constitution's mandate that there should be separation between
church and state."

Well, if that's the Constitution's mandate, I guess a number of
Supreme Court justices and A-list legal academics have somehow missed
the message. In Wallace v. Jaffree (1985), Justice William Rehnquist
called the "wall of separation" a "metaphor based on bad history, a
metaphor which has proved useless as a guide to judging" and "should
be frankly and explicitly abandoned." Justice Potter Stewart
frequently complained that decisions based on a doctrine of strict
separation display a hostility to religion and threaten to establish a
"religion of secularism." Stewart was fond of citing Justice William
O. Douglas's pronouncement in Zorach v. Clauson (1952) that "We are a
religious people whose institutions presuppose a supreme being."
Similar sentiments have been expressed by Justices Warren E. Burger,
Byron White, Antonin Scalia and Clarence Thomas.

On the academic side, the Stanford professor Michael McConnell
(formerly a federal judge) insists that "religion is under no special
disability in public life" ("Accommodation of Religion,"1985 Sup. Ct
Rev. I). McConnell cites the "historical record" as evidence that
"accommodations of religion in the years up to the framing of the
First Amendment were frequent and well known, and no one took the
position that they constituted an establishment of religion." He
derides the separationist mandate as "the narrow ideological position
of the secular elite," a position that "relegates the large majority
of the American public … to second-class citizenship" ("Accommodation
of Religion: An Update," George Washington Law Review, 1992).

McConnell is hardly unique in his views. Stephen Carter of Yale Law
School, Douglas Laycock of Georgetown Law Center, Philip Hamburger of
Columbia Law School, Michael Perry of Emory University School of Law,
Frederick Mark Geddicks of Brigham Young's J. Reuben Clark Law School,
Steven Smith of the law school at San Diego University, Jeff Powell of
the Duke University Law School and the late Richard John Neuhaus,
author of "The Naked Public Square," are just a few of the many who
have argued that the wall of separation thesis is historically,
morally and politically indefensible. (I neither join nor dissent from
this argument; I merely point out how widespread and respectable it
is.)

This of course does not mean that Rick Santorum is right; only that he
is not a total outlier or a nutcase. His views, although perhaps less
well expressed than they might have been, are well within the
boundaries of a legal and political debate that has been going on for
more than a century.

On the one side, there is a line of cases stretching from Reynolds v.
United States (1878) to Employment Division v. Smith (1990) that
define the right of free exercise narrowly: while you are free to
think and express whatever religious beliefs you like, if your beliefs
lead to actions (like taking plural wives or ingesting peyote at a
religious communion) that violate generally applicable laws, you are
subject to criminal penalties.

On the other side, there is a line of cases stretching from Sherbert
v. Verner (1963) and Wisconsin v. Yoder (1972) to Hosanna-Tabor v.
E.E.O.C. (2012) that extend free exercise protection to actions that
flow from a sincere faith even if those same actions — like pulling
your children out of school or discriminating on the basis of
disability — would be disallowed were they performed for non-religious
reasons by non-religious institutions. Religious obligations are
trumped by law and public policy in one set of cases; law and public
policy bend to religious obligations in the other. (It's like a
Gershwin song: I say separation, you say accommodation, except that
there's no chance of calling the whole thing off.)

Related
Campaign Stops: How John Kennedy Looked from Bay Ridge in 1960The same
critics who fault Santorum for espousing extreme views also fault him
for tilting at windmills. No one, they say, is claiming that "faith is
not allowed in the public square." Wrong again. There are legal
philosophers who argue that persons of faith who enter the public
square should check their doctrinal commitments at the door and not
permit themselves even to think religious thoughts when considering
questions of policy. Others are less severe, but still restrictive;
they would allow persons of faith to have religious reasons for
supporting a policy, but insist that before those reasons are offered
publicly, they must be rephrased in a vocabulary accessible to
everyone, that is, in a secular vocabulary.

Still others favor a more expansive accommodationism: They would allow
frankly religious arguments to be made in the public forum even by
legislators, but would require that those who make them be able to
justify their vote in secular terms if asked to do so. And at the most
generous end of the spectrum, where Santorum lives (but hardly alone),
we find the conviction that religious discourse is as good as any
other (and better than most) as a resource for deciding matters of
state and should be a fully enfranchised partner in the political
process.

So while Santorum may have been ill advised to turn from the economy
to social issues and unwise or tone-deaf in his choice of phrases
("makes me throw up" is not in the standard political lexicon),
nothing he has said about the relationship between church and state is
beyond the pale, and much of it is standard, if contested, fare in the
courts and the law reviews.

And the beat goes on. Just last Friday, the Florida legislature sent
to Gov. Rick Scott a bill that would allow students to offer
"inspirational messages" at mandatory school gatherings. The phrase
"inspirational messages" is supposed to inoculate the bill against the
charge that it is just a way of getting prayer back in the schools.
But of course opponents are already calling that a transparent pretext
and their case is helped (and perhaps made) by Scott, who indicated
that he is inclined to sign the bill because "I believe in Jesus
Christ." ( You wonder where his advisers were.)

The battle is already shaping up and when the issue is fully joined in
the courts, as it no doubt will be, you can be sure that the arguments
Rick Santorum has been pilloried for will be heard again in the land.

Rick Santorum’s Super Tuesday Message: Mitt Romney Is a Liar!!!

Santorum's Super Tuesday Message: Romney Is a Liar
By DAVID FIRESTONE

Mario Tama/Getty Images
Rick Santorum speaks during a campaign rally on March 5, 2012 in
Cuyahoga Falls, Ohio.
CUYAHOGA FALLS, Ohio – Rick Santorum closed out his Super Tuesday
campaign by coming quite close to calling Mitt Romney a liar.

At a packed rally here in northeast Ohio Monday evening, Mr. Santorum
said Mr. Romney had endorsed the Massachusetts health care program as
a model for the nation as a whole, and was deliberately misleading the
public into thinking otherwise.

"Not only did Governor Romney advocate for a federal government
program that Barack Obama gladly accepted and did, but now we know
that Governor Romney for the course of this campaign has told the
country something that isn't true," Mr. Santorum said. "It's one thing
to have bad policy, it's another thing to mislead the American
public."

There is a desperation to Mr. Santorum's message. His social
conservatism has backfired; his rants about college, John F. Kennedy
and birth control may have cost him a victory in Michigan last week.
As he said on Monday, "it's gut-check time."

And on this issue, at least, there's not much doubt that Mr.
Santorum's gut is right. His campaign is seizing on an op-ed essay
written by Mr. Romney in 2009, at a time when President Obama was
seriously considering a "public option" that would make the government
an insurer. Mr. Romney argued that his Massachusetts plan, which
mandates coverage and imposes a tax penalty on those without it, would
be much better for the country.

"There's a better way," he wrote in USA Today. "And the lessons we
learned in Massachusetts could help Washington find it." He made
similar remarks in several television appearances at the time.

The architecture of his plan, of course, is the core of the one
Congress passed, but Mr. Romney continues to deny it. At a town hall
in Youngstown, Ohio, on Monday, he even claimed that he'd advocated
against adopting the Massachusetts plan at the federal level.

"When we put our plan in place in our state years ago, I was asked
very early on, is what you've done in Massachusetts something you
would have the entire government do, the federal government," he said
in Youngstown. "I said no. From the very beginning, no."

If Mr. Romney does well in today's primaries, it may be because
Republican voters have come to an accommodation with his contortions,
or at least consider them preferable to Mr. Santorum's unbending
right-wing extremism.

But whatever happens, Mr. Santorum's icy anger makes clear
that—contrary to the hopes of some in the Republican establishment— he
will not bow out of the race. He will continue pounding on lecterns,
railing to the remaining true believers that his rival can't be
believed about the insurance mandate and so much more. Later this
summer, the Obama campaign will pick up where he left off.

15 Potentially Massive Threats To The U.S. Economy Over The Next 12 Months

 Author: The Economic Collapse
We live in a world that is becoming increasingly unstable, and the potential for an event that could cause "sudden change" to the U.S. economy is greater than ever.  There are dozens of potentially massive threats that could easily push the U.S. economy over the edge during the next 12 months.  A war in the Middle East, a financial collapse in Europe, a major derivatives crisis or a horrific natural disaster could all change our economic situation very rapidly.  Most of the time I write about the long-term economic trends that are slowly but surely ripping the U.S. economy to pieces, but the truth is that just a single really bad "black swan event" over the next 12 months could accelerate our economic problems dramatically.  If oil was cut off from the Middle East or a really bad natural disaster suddenly destroyed a major U.S. city, the U.S. economy would be thrown into a state of chaos.  Considering how bad the U.S. economy is currently performing, it would be easy to see how a major "shock to the system" could push us into the "next Great Depression" very easily.  Let us hope that none of these things actually happen over the next 12 months, but let us also understand that we live in a world that has become extremely chaotic and extremely unstable.
In the list below, you will find some "sudden change" events that are somewhat likely and some that are quite unlikely.  I have tried to include a broad range of potential "black swan events", but there are certainly dozens more massive threats that could potentially be listed.
The following are 15 potentially massive threats to the U.S. economy over the next 12 months….
#1 War With Syria – U.S. Senator John McCain is now publicly calling for U.S. airstrikes against Syria.  A military conflict with Syria becomes more likely with each passing day.
#2 War With Iran – A war in the Middle East involving Iran could literally erupt at any time.  The following is from a Reuters news report that was issued on Monday….

President Barack Obama appealed to Benjamin Netanyahu on Monday to give sanctions time to curb Iran's nuclear ambitions, but the Israeli prime minister offered no sign of backing away from possible military action, saying his country must be the "master of its fate."

#3 A Disorderly Greek Debt Default – Many reporters in Europe seem to think that this is becoming increasingly likely.  So what would a disorderly Greek debt default mean for the global financial system?  A leaked report that was authored by the Institute of International Finance says that a disorderly Greek debt default would have some very serious consequences.  You can read the full text of that leaked report right here.
#4 An Economic Collapse In Spain – Spain has one of the largest economies in Europe and it is rapidly becoming a basket case.  As I have written about previously, the unemployment rate in Spain has hit 19.9 percent, and the unemployment rate for workers under the age of 25 is up to 49.9 percent.  Unfortunately, the situation in Spain continues to deteriorate.  The following is from a recent article by Marc Chandler….

However, the devolution in Spain is particularly troubling. The new fiscal compact had just been signed last week, which includes somewhat more rigorous fiscal rule and enforcement, when Spain's PM Rajoy revealed that this year's deficit would come in around 5.8 percent of GDP rather the 4.4 percent target. This of course follows last year's 8.5 percent overshoot of the 6 percent target.
The problem that for Spain is that the 4.4 percent target was based on forecasts for more than 2 percent growth this year. However, in late February, the EU cuts its forecast to a 1 percent contraction. This still seems optimistic. The IMF forecasts a 1.7 percent contraction, which the Spanish government now accepts.

#5 The Price Of Gasoline – The average price of a gallon of gasoline in the United States has risen for 27 days in a row and is now up to $3.77.  Virtually all forms of economic activity are affected by the price of gasoline, and if the price of gas keeps going up it is eventually going to have dramatic consequences for the U.S. economy.
#6 The Student Loan Debt Bubble – Just like we saw with the housing bubble, the student loan debt bubble just continues to grow and grow and grow.  At some point the nearly 1 trillion dollar bubble is going to burst.  What effect will it have on our financial system when that finally happens?
#7 State And Local Government Debt Crisis – It is being reported that California is running out of cash again and there are cities all over the country that are on the verge of bankruptcy.  Could we see a significant municipal bond crisis in the next 12 months?
#8 The Collapse Of A Major U.S. Bank – A number of top U.S. banks are looking increasingly shaky.  In a recent article, David Trainer explained why he has such serious concerns about Bank of America right now….

In my opinion, there are four actions taken by financial services that signal the company is headed to serious trouble.
1. Management shake-up and major layoffs – lots of layoffs over the past year
2. Exploiting accounting rules to boost earnings – SFAS 159
3. Drawing down reserves to boost earnings: to the tune of $13.3 billion in 2011 and 2012
4. Bilking customers with new fees: tried it before and trying it again
Bank of America has taken all four steps.

#9 A Derivatives Crisis – The International Swaps and Derivatives Association recently ruled that the Greek debt deal will not trigger payouts on credit default swaps.  This is seriously shaking confidence in the global market for derivatives.  But the global financial system simply cannot afford a major derivatives crisis.
Estimates of the notional value of the worldwide derivatives market range from $600 trillion all the way up to $1.5 quadrillion.  The notional value of all derivatives held by Bank of America is approximately $75 trillion.  JPMorgan Chase is holding derivatives with a notional value of approximately $79 trillion.
When the derivatives bubble finally bursts it is going to be a financial horror show unlike anything we have ever seen.
#10 The Fall Of The Japanese Economy – The Japanese economy shrank at a 2.3 percent rate during the fourth quarter of 2011.  Japan has a debt to GDP ratio of over 200 percent and a major debt crisis involving Japan could erupt at any time.
#11 A "Solar Megastorm" – Scientists tell us that there is a "1 in 8 chance" that a "solar megastorm" will hit the earth by 2014.  A recent Daily Mail article detailed what some of the consequences of such an event would be….

'We live in a cyber cocoon enveloping the Earth. Imagine what the consequences might be,' Daniel Baker, of the University of Colorado's Laboratory for Atmospheric and Space Physics told National Geographic when asked about a potential 'megastorm'.
'Every time you purchase a gallon of gas with your credit card, that's a satellite transaction.
'Imagine large cities without power for a week, a month, or a year. The losses could be $1 to $2 trillion, and the effects could be felt for years.

#12 A Major West Coast Earthquake Or Volcanic Eruption – On Monday, there was a 4.0 earthquake in San Francisco and a 6.1 earthquake in Argentina.  Is the "Ring of Fire" waking up again?
#13 Tornado Damage To Major U.S. Cities – Last year, the U.S. experienced one of the worst tornado seasons of all time.  This year, we have already seen the worst tornado outbreak ever recorded in the United States in the month of March.  A couple of towns in Indiana were completely wiped out by that outbreak.  So what should we expect when we get to the heart of tornado season this year?
#14 Severe Drought In The United States – Last summer was one of the driest summers on record in the United States, and in many areas there is simply not enough water available for farmers this year.  Some are even projecting that we could see "dust bowl conditions" return to some areas of the country eventually.
#15 An Asteroid Strike In 2013 – Although scientists tell us that the probability is extremely low, the truth is that there is a slight chance that a sizeable asteroid could hit the earth in February 2013.  The asteroid is estimated to be between 60 and 100 meters wide, and it is projected to pass by our planet "at a distance of under 27,000 km".  If it did hit us (and scientists say that the odds of that happening are very low) it would potentially be as serious an event as the Tunguska Event in Siberia in 1908.  Mac Slavo of shtfplan.com recently described how awesome the Tunguska Event really was….

On June 30, 1908 an incoming meteor exploded approximately 5 miles above Siberia. The force of the air burst explosion, estimated at between 15 and 30 megatons, or about 1000 times bigger than the atomic bomb that destroyed Hiroshima, was so powerful that it annihilated everything in an 830 square mile area, and reports suggest that that explosion was heard up to 1000 miles away. Because of the remoteness of the impact zone, the Tunguska Event over Siberia had very little effect on the human population in the region, but the destruction of some 80 million trees in the area shows just how powerful a blast was created.

Of course there are so many other "sudden change" events that could potentially happen – a terror event in a major U.S. city, a deadly pandemic, an EMP attack, cyberterrorism or a major political scandal could all possibly cause a stock market crash and an economic collapse in the United States.
In the world that we are living in today, you just never know what is going to happen.
So what are all of you concerned about over the next 12 months?
Do you see the potential for some "black swan events" to happen?

Sheriff Joe is looking into Obama’s Conn. Social Security no.

New post on Fellowship of the Minds

Sheriff Joe is looking into Obama's Conn. Social Security no.

by Dr. Eowyn

On March 1, 2012, Arizona Maricopa County Sheriff Joe Arpaio held a press conference to present the findings of a 6-month investigation into the murky background of Barack Obama whom the media refused to vett in 2008.

After interviewing dozens of witnesses, examining hundreds of documents, and taking sworn statements from many witnesses around the world, Arpaio's all-volunteer Cold Posse investigators concluded that the online image of Obama's purported long-form birth certificate and his Selective Service registration likely are forgeries.

Some have wondered why Arpaio's team did not look into Obama's curious Connecticut-issued Social Security number.

In this radio interview on Denver's 630 KHOW, beginning at around the 5:45 mark, Arpaio and the posse's lead investigator, Michael Zullo, confirm that they have and are looking into the matter. But it's been "extremely difficult" because they've run into "roadblocks" -- they "can't run that Social Security (SS) number, you can't run any background investigation." Running that SS number through the federal government's E-Verify is now "blocked" as well.

But Zullo notes, wryly, that it is very difficult to explain how a 15 or 16-year-old kid living in Hawaii (Obama) could manage to acquire a Connecticut-issued SS number. Fox TV's Bill O'Reilly had said that Obama's father had obtained that SS number while he was in Yale. The problem, of course, is: Yale University isn't in Connecticut! (The other problem not mentioned by Zullo is this: Obama never went to Yale. LOL)

Arpaio's team's investigation into Obama's college transcripts and admissions is also "ongoing," but the effort has been very difficult. The team is especially interested in Obama's Punahou High School records because annual tuition there was expensive ($5,000 to $6,000). How could his grand parents have been able to afford it?

Zullo is asked about the passport then-Occidental College student Obama used to travel to Pakistan -- what passport? in whose name? Zullo says if they could get that information, "the whole case would be solved." But they couldn't find information on this because the records have been destroyed, including all of Obama's mom's passport records.

Both Arpaio and Zullo also express frustration by how the media are not reporting on their March 1 press conference. Arpaio: "We have the evidence, but no one wants to talk about it."

HAPPY HOUR CONVERSATIONS ON TODAY'S HOT TOPICS

Our signature think-and-drink event is back starting Tuesday, February 21st and then every Tuesday after until March 13. The Humanitini is a relaxed discussion between a panel of experts and a happy hour audience on topics of timely interest or importance. Topics will include:
Distortions of the District - Talk to local film experts about the way Washington DC has been portrayed in both feature and documentary film. Confirmed panelists include filmmakers Aviva Kempner, Ellie Walton, and Steven Nero; as well as representatives from DC Film Girl, Our City Film Festival, and the DC Film Alliance. The panel will be moderated by Amy Saidman of SpeakeasyDC.
The Coexistence of Trains, Cars, Bikes, and Humans - Discuss everything transportation related in Washington, DC! The panel will look at all sides of issues ranging from Metro fare hikes and congested freeways to transportation informed urban planning and bike lanes. Confirmed panelists include Josh Moskowitz from the District Department of Transportation, Monika Samtani, 'The Extra Mile' Transportation Anchor, WUSA9 Morning News, Daniel Hoagland of the Washington Area Bicyclists' Association, Ben Goldman of DCStreets Blog (http://dc.streetsblog.org/), and Jenifer Joy Madden from Greater Greater Washington. The panel will be moderated by Amy Saidman of SpeakeasyDC.
The final two programs will take place at Axum Restaurant and Bar at 1934 9th Street, NW!
Caps, Nats, Wiz, and 'Skins: Finding Community Identity Through Sports - We'll take a humanities spin on local sports fandom. Our panelists and the audience will explore the District's unique sports identity. Can a city with a large transient population attract dedicated home-team supporters? Confirmed panelists include Brian Tinsman from The Redskins Blog, Kyle S. Yeldell from National Newspaper Publishers Association Foundation, Howard University Soccer Head Coach, Michael Lawrence, American football tight end Leonard Stephens, and Edwin Henderson from the Tinner Hill Heritage Foundation. The panel will be moderated by Amy Saidman of SpeakeasyDC. This Humanitini will also feature Demont "Peekaso" Pinder, local artist well known as being the art director for JIVE recording artist Raheem DeVaughn. He will paint a sports themed piece during the panel discussion and it will be auctioned off at the end of the program.
Occupy DC: What is the Price of Freedom? - This program will take a street-level look at the Occupy DC protest, examining its origins and goals as well as the effect it has had on local businesses and city agencies. Confirmed panelists include community activist and lobbyist Erik Jones, and Sinclair Skinner, Legba Carrefour, and Megan Brett from Occupy DC Media team. This panel will be moderated by Andy Shallal, founder of Busboys and Poets.

In the spirit of connecting community to preservation, will you be making any record of this coming Tuesday's February 21 "Distortions of the District" Humanitini? For the historic record, and for humanitarians, residents, and others who may in future want to research back and access this talk by local film experts about the way Washington DC has been portrayed in film, will any video on this fascinating event and topic be recorded and later made available for viewing?

Thank you for all your great work!

Re: Terrible News for Oxycontin Rush Fatblob, Loses Longtime Sponsor

Every time this happens, he picks up more sponsors, and wins another
Marconi or National Broadcasting Award.

"No ink, is bad ink", is a double entendre. Liberal minds just can't
handle that.

Radio Host Loses Longtime Sponsor

COLUMBUS, OH (The Borowitz Report) – Embattled radio host Rush
Limbaugh suffered another major desertion today as he lost the support
of one of his longtime sponsors, Satan.

The usually reclusive Prince of Darkness announced his decision at a
hastily called press conference in Columbus, Ohio, his unofficial
headquarters on Earth.

"Due to remarks of his that we consider unacceptable, we are
terminating our relationship with Rush Limbaugh," Satan said in a
tersely worded statement.

According to one advisor to the Lord of Misrule, Satan had stuck by
the radio host as long as possible but after he called a young woman a
slut on the air Mr. Limbaugh had become "radioactive."

"After a certain point, the association with Rush became problematic
for Satan's public image," the aide said.  "We went through a similar
thing last year with Rupert Murdoch."

Advertisers continued abandoning Mr. Limbaugh's program in droves
today, including companies who had sponsored it for years, like the
online dating site NaziMingle.com™.

The only good news for Mr. Limbaugh today came from GOP presidential
candidate Mitt Romney, who offered this muted statement of support:
"Look, I wouldn't have chosen the words he did.  But it's not like he
called her a poor person or something."
