NOWHERE will you find a Power enumerated for the Feds to regulate, restrict, ban, orchestrate, manipulate or otherwise dictate (save for a uniform date) *anything* to do with Elections. In fact, there is no such thing as a 'Federal' election -- Individuals in States elect their Representative, Two Senators AND (provided the State Legislature desires such) a slate of Electors who choose President.
In addition, Amendment I clearly and plainly states that CONGRESS shall make no law ... abridging the freedom of speech, or of the press ...
What we AGAIN see is that the Constitution itself is meaningless ... epitomized by "[the case] will give the Court an opportunity to consider whether,in light of the huge sums currently deployed to buy candidates' allegiance, Citizens United should continue to hold sway."
According to the Montana Constitution ( http://data.opi.mt.gov/bills/mca_toc/Constition.htm):
- AII, Section 3. Inalienable rights.
- All persons are born free and have certain inalienable rights. They include the right to a clean and healthful environment and the rights of pursuing life's basic necessities, enjoying and defending their lives and liberties, acquiring, possessing and protecting property, and seeking their safety, health and happiness in all lawful ways. In enjoying these rights, all persons recognize corresponding responsibilities.
- AII, Section 7. Freedom of speech, expression, and press.
- No law shall be passed impairing the freedom of speech or expression. Every person shall be free to speak or publish whatever he will on any subject, being responsible for all abuse of that liberty. In all suits and prosecutions for libel or slander the truth thereof may be given in evidence; and the jury, under the direction of the court, shall determine the law and the facts.
- All persons are born free and have certain inalienable rights. They include the right to a clean and healthful environment and the rights of pursuing life's basic necessities, enjoying and defending their lives and liberties, acquiring, possessing and protecting property, and seeking their safety, health and happiness in all lawful ways. The REAL problem with elections and campaigns stems from Government performing illegitimate tasks it has no business participating. Legitimate Government secures (natural) rights <period>. Anything done contrary serves only to provide advantage to some at the expense of others. Vying for that advantage (which is then given) is the real problem.
