I agree with PlainOl, the crux of this matter rests with whether Martin believed that he was being attacked, and that his life was in danger. The State Attorney's Office (in this case, now, a State Special Prosecutor) must have a sufficient indicia of reliability to establish that Martin acted recklessly, and for a second degree murder charge, even a manslaughter charge, although motive or pre-meditation is not requisite, the State has to show that Martin acted with abandon; that there was an intent, outside of self defense.
These are facts, that would have to be determined by a jury, but unless the State believes that it can actually prove and show these facts, there's no need to charge Martin.......Thus, the reason that he has still not been charged to date.
