Re: Vendor of President Barack Obama condoms arrested again in New York

I was enjoying your point of view and sound thought about this case.  I was thinking-wow: What a great legal point of view.  Then I got to the last line and had a fantastic chuckle.  One that is well needed first thing in the morning....

Assuming that this gentleman prevails on Appeal, which I assume he will based on what I know of this case,  he should file against the City of New York, and specifically against whatever law enforcement agency is arresting him after a court has said that his actions are legal.  this is clearly in violation of 42 USC Section 1983 & 1985, and I don't believe that any law enforcement agent who arrests this guy would be immune from litigation.  In other words, law enforcement,  in my professional opinion,  could very well be liable for damages caused by the arrest, loss of profit, loss of sales,  the consequences of being incarcerated,  (again loss of sales and profit; just on another level)  and collateral damages. 
 
I hope he busts the City of New York's ass over this; and whatever bureaucratic Moonbat is giving instructions for his arrest.
