Re: Good for the airlines - check out the comments as well

Over the years I have grown to believe, as did Herbert Spencer in the 1800s, that if government intervention into one's life should be allowed at all, it should be confined to punishing those guilty of what British common law classified as malum in se (wrong or evil in itself). Beyond this the State should not go. Murder, arson, theft, and assault would qualify as malum in se.

Unfortunately, the overwhelming majority of all laws fall under the classification of malum prohibitum (wrong merely because they are prohibited). Traffic laws, the possession of marijuana, public intoxication, and trespass are examples of malum prohibitum.

Marman could have been removed from the plane and merely sent on his way.

because he refused to remove himself from the plane.  He had to be forced off therefore he was trespassing.  Also his attitude to the staff on the plane probably added to the problems they had.  Perfectly justified in arresting him IMNSHO.

The airline has every right to enforce their dress code, but since Marman had a ticket, how is anything more than removing him from the plane justifiable? How do the police justify citing Marman for trespassing? It is simply abuse of power.
