Who is Raghuveer Nayak?

WASHINGTON — The House Ethics Committee announced today it will
continue to investigate whether U.S. Rep. Jesse Jackson Jr. or an
emissary directed or knew of efforts to raise campaign cash for then-
Gov. Rod Blagojevich in return for Jackson's appointment to the Senate
in 2008.

In making the announcement, the panel released findings from an
initial review by another office that found "probable cause" Jackson
either directed someone to offer to raise funds in exchange for the
seat or knew such an offer would likely be made. Jackson was never
named to the Senate.

Jackson, 46, a Chicago Democrat, has been under scrutiny after his
allies reportedly offered at least $1.5 million in campaign cash to
Blagojevich for the appointment.

The ethics panel also has been examining whether Jackson misused
federal dollars allocated for personnel and office expenses by
utilizing "staff resources" to mount a "public campaign" to secure the
appointment.

The Office of Congressional Ethics looked into the allegations in
2009. Unlike the House Ethics Committee, the office is not empowered
to discipline House lawmakers, nor can it ascertain guilt or
innocence.

But it did compile a report on its findings in August of 2009. Among
the key points:

-- "There is probable cause to believe that Representative Jackson
either (1) directed a third-party, most likely Mr. Raghuveer Nayak, to
offer to raise money for Governor Blagojevich in exchange for
appointing Representative Jackson to the Senate seat, or (2) had
knowledge that Nayak would likely make such an offer once
Representative Jackson authorized him to advocate on his behalf with
Governor Blagojevich.

-- "Because former Governor Blagojevich, Nayak and Mr. Rajinder Bedi
(another fundraiser) have declined to cooperate with the OCE
investigation, and because the OCE cannot compel their cooperation,
the OCE is unable to determine whether there is a substantial reason
believe these allegations."

Jackson has consistently denied any wrongdoing and renewed his denial
Friday. He said in a statement he will "continue to fully cooperate"
with the House Ethics Committee and expected to be "vindicated."

"I have said from the beginning that I publicly and transparently
sought to have the governor of Illinois appoint me to fulfill the
final two years of then-Senator Barack Obama's term in the U.S.
Senate," Jackson said in the statement. "I did nothing illegal,
unethical or inappropriate in that pursuit and I believe that is what
the Ethics Committee will conclude at the end of this process."

The congressman also said he was grateful that the committee has
decided to release documents in the case, saying that for the first
time in three years "my side of the story will be made public and for
that I am grateful."

One of the documents is a 17-page letter from two attorneys for
Jackson. The letter, dated Nov. 15, was sent to the Ethics Committee
chairman, Rep. Jo Bonner (R-Ala.) and to the committee's top Democrat.

It says in part: "Congressman Jackson respectfully submits that there
is no basis for OCE's conclusion that he may have violated House rules
or federal law and urges the Committee to close its investigation of
this matter."

Last May, at the second of two Blagojevich corruption trials, Jackson
contradicted prosecution witnesses and testified that he did not know
about or authorize anyone to offer the governor money for the Senate
seat.

Jackson, who represents the South Side and nearby suburbs, entered
Congress in 1995. His father is civil rights leader, the Rev. Jesse
Jackson. The representative's wife is Chicago Ald. Sandi Jackson.

Blagojevich will be sentenced Tuesday on 18 federal counts, including
attempted extortion for trying to sell or trade the Senate seat, which
became vacant when Barack Obama was elected to the White House.

The House Ethics Committee, which operates largely in secrecy, is
composed of 10 lawmakers: five Republicans and five Democrats.

Oddly enough, coming from the John Birch Society, this does NOT mention that the Constitution has very limited and EXACT causes for the United States to gain authority over the use of land on the Continent.  Those are listed in ARticle I, Section 8, paragraph 17 which says, on the subject, "...to exercise like Authority over all Places purchased by the Consent of the Legislation of teh State in which the Same shall be; for the Erection of Forts, MAgazines, Arsenals, dock-Yards and other needful Buildings;-And"
Nowhere in that paragraph is the purchase authorized for Resources or for 'National' anything.  That being said, all the Departments affected by this bill are actually null and void for Constitutional violations, in my opinion.

Stop Extensive Federal Land Grab
 
The National Security and Federal Lands Protection Act, H.R. 1505, is an extensive land-grabbing bill by the federal government in the name of "national security." The proposal gives the Department of Homeland Security (DHS) and specifically the Customs and Border Protection (CBP) agency, which is under the DHS, authority over a 100-mile inland swath of land across the northern and southern borders of the United States "for purposes that assist in securing the border (including access to maintain and construct roads, construct a fence, use vehicles to patrol, and set up monitoring equipment)."

This bill waives some 36 laws currently in place for lands managed by the USDA and the Department of the Interior, some environmental, some farmland preservation, others that cover Native American Indian lands, monuments, etc., while giving sweeping powers to the DHS and Border Patrol to exercise "operational control" on the specified lands. A decades-old law that allows the courts to review executive branch agencies' activities would also be waived; DHS and CBP's activities would be unaccountable and untouchable.

Rep. Rob Bishop (R-Utah) who introduced the bill insists that environmental laws are getting in the way of the Border Patrol's ability to do its job. The Government Accountability Office did a year-long study to determine whether or not  land management laws were hampering the Border Patrol. The findings showed that 22 out of 26 border patrol stations reported  "the overall security status of their jurisdiction is not affected by land management laws. Instead, factors such as the remoteness and ruggedness of the terrain have the greatest effect on their ability to achieve operational control."

It needs to be noted that in March of 2006, an agreement was signed between the DHS, Department of the Interior and the USDA that already gives the Border Patrol access to public lands, either when they request it OR when they are in hot pursuit of suspected illegals, terrorists, drug smugglers, or for search and rescue missions.

The signed memo -- Cooperative National Security and Counterterrorism Efforts on Federal Lands Along the United States' Borders -- gives the Border Patrol all the tools they need to keep the borders safe, including access to all the public lands currently managed by the USDA and the DoI, the ability to erect surveillance equipment, sensors, cameras etc. Conflicts between the three are supposed to be settled at the lowest authority level possible, while allowing CBP to protect the border. Everything that is contained in the mutual agreement is also in the proposed legislation, but the legislation goes much further.

Centralizing this kind of unilateral power in the hands of armed government agents should be frightening. Furthermore, imagine the kinds of activities that could be restricted or eliminated on public lands in the name of national security: timber harvesting, livestock grazing, hiking, hunting, fishing, camping, oil and gas exploration and drilling, etc. All of this could happen under such a broad bill, and one that is completely unnecessary.

If Congress and the DHS were serious about patrolling the borders, they could put into effect some serious efforts AT THE BORDER, not up to 100 miles inland. Concern for real national security, individual state sovereignty, and protection of private property should inspire us to contact our Senators and Representative and get them to oppose H.R. 1505, the latest federal land grab.

As reported by CNBC, "the jobs market showed more signs of weakness" last week as applications for unemployment benefits rose to 402,000. Applications for unemployment, say economists interviewed by that network, need to consistently "stay below 375,000" for the unemployment rate to go down significantly. Applications have not been at that level since February of this year.  

Bloomberg News reported that the 8.6% jobless rate for November is partly due to "a 278,000 gain in employment at the same time 315,000 Americans left the labor force" while the labor participation rate "declined to 64 percent from 64.2 percent." In addition, Bloomberg noted that a temporary bump could also be attributed to seasonal considerations because "employment at service-providers increased 126,000, including a 50,000 gain in retail trade at companies hired for the holiday shopping season. The number of temporary workers increased 22,300." The news agency also reported: "The jobless rate has exceeded 8 percent since February 2009, the longest stretch of such levels of unemployment since monthly records began in 1948."

Although the November jobless rate was 8.6%, October had marked the 33rd consecutive month that the national jobless rate has remained close to or well above 9%. Unemployment climbed to 8.5% in March of 2009, reached 10.2% in October of that year, and remained close to that number throughout 2010. At the beginning of 2011, the unemployment rate was 9%, and while it dipped to 8.8% in March, it quickly rose again and has remained above 9% ever since. November's 8.6% overall jobless rate does not reflect the significant, ongoing challenges faced by young Americans. For example, The New York Times reported a youth unemployment rate of 18.1% in an August 25th story.
