John Kerry bails on taxing questions

Sen. John Kerry, hounded by questions over whether he is dodging state and local taxes on his ultra-luxe $7 million sailing yacht, yesterday slammed his car door on a pack of reporters demanding to know if he would pony up to the cash-strapped commonwealth.

"Can I get out of here, please," the harried senior senator said before sailing off into the sunset after an event at the former South Weymouth Naval Air Station .

Kerry continued to insist that he and his wife, ketchup heiress Teresa Heinz, would pay whatever taxes they owe on his new New Zealand-built Friendship sloop Isabel, but wouldn't specifically address whether he'd cough up some $500,000 in state use and local excise taxes.

"Let's get this very straight, I've said consistently we will pay our taxes, we've always paid our taxes, it's not an issue. Period," a clearly perturbed Kerry declared.

But GOP candidate for state treasurer Karyn Polito yesterday wrote to Gov. Deval Patrick to request a Department of Revenue investigatation into whether Kerry owes any dough to the commonwealth.

"Senator Kerry should not be allowed to exempt himself from paying taxes in Massachusetts by moving high-value property he owns out-of-state," she wrote. "Massachusetts is in the midst of a financial crisis where deep cuts in services have become commonplace. The nearly half-million dollars that Senator Kerry potentially owes the Commonwealth can be used to restore cuts to worthwhile programs that provide healthcare, shelter and clothing to the poor."

The Track broke the story of the summer last week when we reported that the former White House wannabe had purchased a spankin'-new 76-foot luxury yacht in New Zealand and registered it in Rhode Island, thus dodging Massachusetts' 6.25 percent sales tax and depriving the senator's summer home, Nantucket, of some $70,000 a year in excise taxes.

The Ocean State repealed its Boat Sales and Use Tax back in 1993, making the tiny state a haven - like the Cayman Islands, Bermuda and Nassau - for tax-skirting luxury yacht owners.

However, according to state law, if Kerry brings the boat into Massachusetts waters in the first six months of owning it, there is a "presumption of use" and he would have to pony up some $437,500 to the state.

When asked yesterday whether he had brought the Isabel into Massachusetts, Kerry replied, "It depends on who owns it."

Kerry declined to elaborate and a spokesman didn't respond to our query, leaving us to wonder whether the senator is looking for another legal loophole to sail through.

Maritime law expert Brian Flanagan, who teaches admiralty law at Suffolk University Law School, said it is possible Kerry may have taken possession of the custom-built craft more than six months ago, even though he registered it with the Coast Guard on March 12. Another source suggested that Kerry has not yet paid in full for his new high-seas plaything.

But even if they didn't beat the six-month deadline, John and Ta-ray-za also could challenge the state's "presumption of use" and present evidence that he did not purchase the vessel for use in the commonwealth, Flanagan said.

"There's a line in the old movie 'The Firm' that the difference between tax avoidance and tax evasion is a good lawyer," Flanagan said. "What he's saying and what he's doing is absolutely legal. This has been going on for years."

We told you previously that Kerry's boat was spotted on Nantucket, where he and the missus have a summer home, over the July 4 holiday weekend. And Kerry was seen coming ashore off the Isabel in Edgartown a couple of weeks later.WBZ reported yesterday that the yacht has been docked at the Nantucket Boat Basin "numerous times" this summer.

Kerry said yesterday that the boat currently is being worked on in Rhode Island but will return to Massachusetts once the repairs are completed.

There is now a list going around in conservative websites purporting to be "The List" of media participants in Journolist. It's fake. How do I know? I'm on The List. And I was never on Journolist.

Don't get me wrong, I would have loved to have been on Journolist. It sounds fun. I'd like being on The List even more. That sounds bad ass. Someone I know was on Nixon's Enemies List - I've always thought that was the single coolest distinction anyone could have. This is as close as I got. As much as I would have loved it, I shouldn't be on The List.

Why do I make this painful admission? Is it because I don't want to be associated with those no good libs secretly controlling the media? Hell no. Would have loved that, too. It's because you should know that people that are on that so-called "confirmed" list were not necessarily on Journolist. As usual, the conservative media seems to have completely made this up. Seen this movie before?

I guess I should consider it a compliment that I was on the made up list. In other words, someone thought if there is going to be a liberal media conspiracy I was probably involved. That's pretty cool. But I have a more important question about this purported scandal.

The conservative critics claim this proves the media is all a liberal conspiracy. And as part of the proof, they show e-mails from Journolist trying to sway the media to cover things with a liberal slant. But if the media is already liberal why do the liberals have to convince them?

Some of the e-mails seem to show people strategizing over how to swing the narrative in the press. Well, if it's a conspiracy, why don't they just call up the New York Times, Washington Post, ABC News, etc. and just get them to run their liberal buddies' ideas as facts? Why do they have to try so hard to figure out a way to influence them through their own articles?

Wouldn't this prove the opposite - that the mainstream media is not liberal? They hardly ever listen to these self-avowed liberal journalists. The people on this mailer seem to be on the outside looking in, trying to figure out how the influence the conversation (presumably the same exact thing conservative journalists and advocates are doing).

In fact, in one of the first stories that The Daily Caller ran, they share e-mails from the list about anger toward George Stephanopoulos for asking about Rev. Wright during the 2008 debates. Well, if they run the media, why didn't the liberals just get George not to ask that question? Why did the so-called liberal media ask such a conservative question in the first place? If it's a conspiracy why won't Stephanopoulos listen to them?

In other words, why won't the liberal media listen to the liberal media?

Now, for the extra irony - one of the other questions Stephanopoulos asked in that same debate was planted by ... Sean Hannity. Stephanopoulos was on Hannity's show when pressed about Obama's connection to Bill Ayers and decided that he would ask it in the debate. So, is there then a conservative media conspiracy?

Of course, the reality is that the media has many forms. There are straight news reporters and there are advocate journalists, like some people on Journolist and almost everyone at Fox News (I had to say "almost" because of Shep Smith, damn him for making things complicated) .

Of course, many of the people on Journolist freely admit that they write for liberal publications like The Nation, whereas Fox News claims to do fair and balanced reporting. So, they're both advocates, just one side is lying about it (I'm always amused by this lie; how can anyone say with a straight face that Fox News doesn't have a conservative perspective? ).

Finally, let me ask you one more question. If the liberal media is so strong how come all of the liberals in the country don't have as much influence as just Glenn Beck? That's really painful to write, but clearly true.

Here's my proof. Every progressive organization, leader, advocate, journalist, congressmen, etc. have said that Elizabeth Warren should be nominated as the head of the Consumer Financial Protection Bureau. Yet, they still can't get the job done. It is at best a 50-50 proposition right now. Yet, just the thought that Shirley Sherrod might be on Glenn Beck's show on one night is enough to get her fired.

The mere threat of Beck swings the Obama administration immediately. That's power. That's influence. All of the progressives and liberals in the country put together can barely move the president on Warren. And this is supposed to be a liberal president with a liberal media? What an unbelievable joke.

Nobody Can Fire Andrew Breitbart

As the mainstream media synchronized their watches over the Shirley Sherrod affair, the object of their little trench raid was clear. Demonize Andrew Breitbart for the unethical publication of a video featuring Ms. Sherrod uttering racist remarks at an NAACP awards dinner.

You could see the strategy. The MSM wanted to discredit and demonize Breitbart so that he could be fired or marginalized, just like Rush Limbaugh was fired from ESPN for the thoughtcrime of suggesting that the media wanted Donovan McNabb to succeed as the Philadelphia Eagles' quarterback because he was black.

But then I thought: Yeah, but who can fire Andrew Breitbart? 

When Rush Limbaugh wanted to buy the St. Louis Rams, the Ruling Elite trailed a few stories about his supposed racist remarks. They pressured the NFL, and the NFL could pressure the syndicate to remove Rush.

But Andrew Breitbart? Can anyone fire him?

For that matter, what about Rush? You can kick him off ESPN; you can kick him off the St. Louis Rams. You can even force Snapple drinks and the Florida oranges off his radio show. But "they" haven't been able to fire him from his position as host of the Rush Limbaugh Program. The reason is, I suspect, that Rush's show is owned by not a public corporation, but a private venture. Rush has to keep the confidence of only his partners and affiliates, not the executive committee of the Ruling Class as a whole.

No doubt the same is true of Andrew Breitbart.

Here we see the late-dynasty stupidity of the Ruling Elite. A Ruling Elite that was up to the job would have co-opted or destroyed Limbaugh and Breitbart long ago. 

Rush remarked on his radio show last week that he anticipated, when he moved to New York in 1988 and made talk radio into a national phenomenon, that he would get accepted into the social circles of the media elite. 

But the invitation never came. Sorry, old chap -- not Ruling Class solidarity, you see.

Even Rush's acceptance into the modest social circle of conservative media was a big deal for him. When Bill Buckley died, he spoke on his show about his first visit to Buckley's New York home. He had his driver drive around the block before he could summon up the courage to enter Buckley's lair.

This is the guy who fearlessly skewers liberals daily on the EIB Network's fun, frolic, and serious discussions of the issues.

I suspect that Andrew Breitbart is even less biddable than Rush.

There is a generational pattern here. In Generation One, we had Buckley, the Catholic rich man's son with a non-profit movement. In Generation Two, we had Rush, the local WASP judge's grandson and a for-profit enterprise. But Generation Three, with Drudge and Breitbart, is an outsider generation, a trouble-making insurgency. Drudge (born 1966) and Breitbart (born 1969) are both Jewish, and they take their place in a conservative movement that is increasingly combative and increasingly led by Jews.

In Generation One, conservatives fenced with the Ruling Class using foils, masks, jackets, and breeches. In Generation Two, conservatives roamed in the talk radio AM band hinterland around the Ruling Class's NPR-fortified cities. Now, in Generation Three, conservatives move through the internet as a fish swims in the sea.

In Generation One, conservatives wanted to be treated as part of the elite. So they were, grudgingly; Bill Buckley got his "Firing Line" show on PBS, and Milton Friedman got his "Free to Choose." Generation Two never got past the TV Nazis. No PBS shows for them. Rush's syndicated television show was confined to middle-of-the-night time slots. Generation Three is different. It aims to get respect with hard-knuckle action in the mean streets of the internet. That is what Andrew Breitbart is all about, as Kyle Wingfield recognizes:

Breitbart is clear about his desire to turn the tables on liberal media and activist groups. That's why he went after ACORN, and why it makes sense that he'd set his sights higher than an obscure bureaucrat.

Breitbart aimed to play the race card right back in the face of the racist NAACP. While the media was busy getting its knickers in a twist about out-of-context quotes, Breitbart had managed to make fools of both the NAACP and the Obama administration.

Or maybe it's just a coincidence that the Rasmussen Presidential Approval Index dipped to -20 over the weekend.

You can't hurt Andrew Breitbart by playing the "out-of-context" card, the one that leads into a demand to have the conservative racist fired. In the kind of ball that Breitbart plays, there is no appealing to the friendly umpire or the CEO who fears a call from the White House.

Breitbart is BigGovernment.com. He is BigJournalism.com, and BigHollywood.com, and BigPeace.com. He's not shilling for some Mr. Big, some right-wing George Soros. 

Guess what, liberals. He can't be fired.
