Ginsburg to Egyptians: I wouldn't use U.S. Constitution as a model

This is just outrageous. Other than her being female, what exactly was Ruth Bader Ginsberg's qualifications to sit as one of our premiere judges? I cannot recall any Opinion written by Ginsberg that was of any significance or even that I agreed with. She is one of those judges that in my professional opinion, writes to hear herself talk....

By the way, this is almost two months old. I don't know how I missed this, and I am just downright flabberghasted that Tom For News did not post this story, being that he is so "Up To Date" in news gathering, especially important stories that affect us all!

As Egyptian officials prepare to send to trial 19 American democracy and rights workers, Supreme Court Justice Ruth Bader Ginsburg visited Cairo last week where she suggested Egyptian revolutionaries not use the U.S. Constitution as a model in the post-Arab Spring.

"I would not look to the U.S. Constitution, if I were drafting a constitution in the year 2012," Ginsburg said in an interview on Al Hayat television last Wednesday. "I might look at the constitution of South Africa. That was a deliberate attempt to have a fundamental instrument of government that embraced basic human rights, have an independent judiciary. It really is, I think, a great piece of work that was done."

As Egypt prepares to write a new constitution, Ginsburg, who was traveling during the court's break to speak with legislators and judges in Egypt as well as Tunisia, spoke to students at Cairo University, encouraging them to enjoy the opportunity to participate in the "exceptional transitional period to a real democratic state."

Its' been a while since I have watched that video, at least a year, but I do recall it, and thought it was quite thought provoking. I don't recall anything about religion being a part or parcel of General Boykin's dissertation.

Thanks for sharing this video Tom, I had heard about it, but this is the first time I had seen it. I note from the Los Angeles Times article that contained the Sanford PD film:

"A Sanford police officer who responded to the incident, Timothy Smith, noted in his police report that when he arrived on the scene, Zimmerman had a bloody nose and blood on the back of his head. His back was wet and covered in grass, "as if he had been laying on his back on the ground," Smith wrote."

"Smith said Zimmerman was placed in the back of the squad car, where he was given medical attention by the Fire Department."

I agree with PlainOl, the crux of this matter rests with whether Martin believed that he was being attacked, and that his life was in danger. The State Attorney's Office (in this case, now, a State Special Prosecutor) must have a sufficient indicia of reliability to establish that Martin acted recklessly, and for a second degree murder charge, even a manslaughter charge, although motive or pre-meditation is not requisite, the State has to show that Martin acted with abandon; that there was an intent, outside of self defense.

These are facts, that would have to be determined by a jury, but unless the State believes that it can actually prove and show these facts, there's no need to charge Martin.......Thus, the reason that he has still not been charged to date.
