Maine: As reported previously, Maine is holding strong. The recent
poll showing 58% in support of marriage equality is a hopeful sign.
Will be interesting to see how the President responds to the Maine
effort since the LGBT community are the ones putting the issue on the
ballot unlike the other states.

Washington State: Those attempting to stop the legislature passed
marriage equality in Washington are off to a slow start. They have two
month left to obtain a 'safe' 150,000 signatures and so far only a
little over 5,000 have been reported. However, there is some sense
that the organizers are holding back petitions sent to over 1,500
churches in the state. My guess is they are low balling it to catch
the media by surprise.

North Carolina: Impressive is the world to describe the organizers
against Amendment 1 in North Carolina. With very little resources and
most people nationally writing them off, they have organized a really
first rate campaign. So far they have raised over a million dollars,
lined up impressive endorsements (see video's), obtained Obama's
opposition to the amendment and just keep plugging away at what seems
like long odds. In an interesting way, Santorum giving up on his
campaign for the Presidency will help them since the Republicans had
counted on a tough primary race in North Carolina to draw out their
vote in May.

(W)e ought to be asking ourselves why corporations and interests groups are willing to give politicians millions of dollars in the first place. Obviously their motives are not altruistic. Simply put, they do it because the stakes are so high. They know government controls virtually every aspect of our economy and our lives, and that they must influence government to protect their interests.

Our federal government, which was intended to operate as a very limited constitutional republic, has instead become a virtually socialist leviathan that redistributes trillions of dollars. We can hardly be surprised when countless special interests fight for the money. Richard Posner, a member of the U.S. Court of Appeals for the Seventh
Circuit and arguably the country's most influential federal judge, is
also a prolific blogger. I feel pretty good about trying out new media
after a long career in old media, but I have nothing on Mr. Posner,
who's 73.

His recent post about Citizens United is important reading for anyone
interested in campaign finance regulation. In the 2010 case Citizens
United v. Federal Election Commission, the Supreme Court held that
Congress cannot limit independent expenditures in political campaigns,
arguing that such expenditures are not donations so much as
expressions of preference. The Citizens United decision, as well as
lower court rulings and F.E.C. policies that rely on it, helped give
rise to super PACs — the supposedly "independent" groups that no one
in their right mind thinks are independent.

The Court, in all its wisdom, figured that the risk of corruption was
slight; the decision would merely allow people (people with a lot of
money, anyway) to voice their opinions as loudly and as often as they
liked. No big deal, it's just speech. Mr. Posner argues that the
justices were shockingly naïve. He writes that it is "difficult to
see what practical difference there is between super PAC donations and
direct campaign donations, from a corruption standpoint. A super PAC
is a valuable weapon for a campaign, as the heavy expenditures of
Restore Our Future, the large super PAC that supports Romney and has
attacked his opponents, proves; the donors to it are known; and it is
unclear why they should expect less quid pro quo from their favored
candidate if he's successful than a direct donor to the candidate's
campaign would be."

The short version: contributions to super PACs have the same ability
to corrupt candidates as those made directly to candidates.

Instead of accepting the status quo, Congress could use this premise
(obvious to everyone but the justices) to enact new limits on
contributions to "independent" groups; it could invoke the
constitutional rationale that such contributions have the ability to
corrupt federal officeholders and government decisions.

By Congress I mean a hypothetical legislative body that's not
dysfunctional, not the one we currently have, which won't do a thing.

Short of broad action against unlimited contributions, there's not a
whole lot that can be done to improve the election system, despite the
best intentions of would-be reformers. A coalition calling itself New
York Leadership for Accountable Government has begun pushing for
public financing within the state, which is certainly a worthy goal.
But even if they get to a place where candidates can partially rely on
some kind of public bursary instead of going begging to big donors,
there's nothing to stop a big donor from interfering with the race
through a super PAC.

The modern drive against gun control started with an expansive
interpretation of the Second Amendment as bestowing an absolute,
individual right to "keep" and "bear" arms, rather than a societal
right based on the need for a "well-regulated militia."

But we are now in a new and dangerous phase of the gun movement, in
which extremists led by the National Rifle Association are pushing
beyond "keep" and "bear" to "use." They are pressing state and federal
lawmakers to make it easier for people to shoot other people.

As Erica Goode reported in today's Times, the killing of Trayvon
Martin by an armed vigilante in Florida has focused attention on the
successful campaign by the N.R.A. and the American Legislative
Exchange Council, a right-wing lobbying group, to pass "stand your
ground" laws in more than two dozen states in recent years.

In 2011, Republican lawmakers in Wisconsin worked with both of those
groups to pass a bill that started out as an effort to make it harder
to prosecute someone who used deadly force against an intruder in his
home – but then morphed into a license to kill that applies on lawns,
sidewalks and swimming pools outside the residence, as well as
vehicles and places of business.

Part of what makes this effort so insidious is that it is largely a
solution in search of a problem. All states have long upheld some
version of the so-called Castle Doctrine (which comes from the old saw
about a man's home being one), granting individuals the right to
protect themselves against intruders. Historically, this was often
coupled with a "duty to retreat" before resorting to lethal force,
which seems perfectly reasonable. Why end someone's life if it's not
absolutely necessary?

There is no epidemic of homeowners going to jail after defending
themselves from a break-in. On the contrary, juries are often
extremely lenient. In Colorado more than 30 years ago, I covered a
trial in which an Iranian student was acquitted after he shot and
killed a 15-year-old with a deer rifle, from his balcony, across the
parking lot of his apartment complex, at night, because he thought the
youth and his friends had thrown a bomb through his window.

This ought to be a good time for a discussion about gun control. But
the N.R.A. starts its national convention tomorrow in St. Louis, Mo.,
and you can be sure there will be no such discussion. Only
triumphalist statements of progress in the fight against sensible gun
control and dire talk about how we're all at risk of someone bursting
into our homes—or swimming pools—at any minute.

They certainly will not discuss these statistics, compiled by the
Violence Policy Center, on the homicide rate for African Americans,
which is more than three times the overall homicide rate. The
overwhelming majority of victims are killed by guns, and the majority
of those are killed by handguns. Missouri leads the nation in this
appalling statistic.

community hit another bump in the road this week when the White House
declined to push through an executive order banning government
contractors from discriminating against employees based on sexual
orientation or gender identity.
And while that move raised eyebrows, it's not the major sticking point
between the GLBT community and Obama. That, of course, is gay
marriage.

Salon's Steve Kornacki this week points out that, while most of the
Democratic Party's class of potential 2016 presidential contenders
supports gay marriage, Obama has still, despite indications that he
may change his position at some point, declined to jump on board. Such
a move that would make him first major-party presidential nominee to
do so but would hardly make him a trailblazer in Democratic politics.
But gay marriage advocates shouldn't hold their breath.

According to Fix interviews with more than half-dozen Democratic
strategists, basically nobody in Obama's party is expecting him to
make the switch before the election. And even supporters of gay rights
suggest the timing might be wrong.

While many may see it as the right thing to do, they say pulling such
a switch would be too difficult this close to an election.

"I don't expect him to change his position at this point," said
Democratic strategist Joe Trippi. "On the one hand, it would be a
welcome surprise for many, and on the other hand, be seen as
politically motivated and polarizing to others because of the timing."

Most Democrats agreed that raising the issue in the context of the
election might be counterproductive even for the gay rights movement
itself.

"Speaking as a gay person, he should do what he believes is best for
the country," said former Obama adviser Steve Hildebrand. "If
endorsing gay marriage is best, then that is what he should do. I
would encourage him to do what he believes is best for the country and
to not let politics play a part if that is possible."

Obama, of course, has made inroads — significant ones — with the GLBT
community, most notably ending the military's "Don't Ask, Don't Tell"
policy for gays in the military and speaking out against California's
Proposition 8, which overturned the state's gay marriage law.

He has also spoken out against a federal amendment defining marriage
as between a man and a woman — the Defense of Marriage Act (DOMA).

Given what the president has already done, it's not clear that taking
it a step further would be at all beneficial. Indeed, it may hurt.

"It would give (Mitt) Romney an issue to try to blunt his serious
flip-flopping problem, and the president has already shown his strong
commitment to equality for LGBT Americans in ending don't ask, don't
tell, passing hate crimes bill, speaking out against DOMA and state
level anti-gay marriage legislation," said a Democratic strategist.

Despite all of that, gay marriage is very much a sticking point for
many in the gay community. And given the plenty of big-name Democrats
have jumped on-board, the pressure on Obama to follow suit is growing
by the day.

While there has not been a large-scale rebuke of the president by gay
marriage supporters, there is some indication that the issue could be
coming to a head.

The newly named chairman of the Democratic National Convention, Los
Angeles Mayor Antonio Villaraigosa, has said gay marriage may be voted
on as part of the party's platform this year — a move that would
really force the issue.

Either way, the issue is picking up steam. Several states have moved
to allow gay marriage in recent months, and polling, for the first
time, shows a majority of Americans support such laws.

That might suggest Obama would be well-served to support the law.

But even if you set aside the idea that such a move would look
transparently political, backing gay marriage doesn't gain Obama much.
He's already got many supporters in the gay community thanks to the
things he has done, and backing gay marriage really only risks
alienating independent voters and firing up a conservative base that
isn't quite raring to go right now.

Opposition to gay marriage, after all, is much more strident than
support, and make no mistake: Social conservatives would be up in arms
if Obama started pushing gay marriage.

"Right now the far right is not motivated to support Romney," said one
Democratic strategist who worked on Obama's 2008 campaign. "Supporting
gay marriage in an election year would do wonders for motivating the
right-wing Republican base, and that's not something I can imagine the
president doing."

For his part, Obama hasn't said much on the issue in recent months,
and his campaign doesn't appear anxious to make gay rights a key issue
in the looming campaign.

Campaign spokesman Ben LaBolt said Obama will decide when the time is right.

"The President and the President alone will come to a decision,"
LaBolt said in a statement. "From allowing hospital visitation rights
for gay partners to repealing 'Don't Ask, Don't Tell,' President Obama
has done more to advance equal rights for gays and lesbians than any
other President — a record we intend to highlight."

I got to meet he and kenny at a vineyard they played in Arrington,
TN ... both were very nice.

Arrington Vineyards in Williamson County used helicopters early
Thursday morning to warm the air in an effort to keep frost off their
grape vines.

Two helicopters circled the vineyard to warm the air for hours.
Throughout the morning, censors showed the air temperature was below
32 degrees, which could kill vegetation.

Kip Summers, the president of Arrington Vineyards, said the
temperature dropped as low as 29 degrees, so the choppers didn't
prevent frost at the lowest locations. However, the helicopters
prevented a prolonged freeze event, and many of the fruit clusters on
the frosted vines survived.

Summers said without the help from the helicopters, he thinks they
would have suffered a 100 percent crop loss. He said he thinks they
lost only 10 percent of their crops from the freeze.
