Indian government finds out another Afzal Guru


(November 11, William's Desk)      Times Now, a 24-hour English language news channel based in Mumbai has plotted story against the Bangladesh army to twist the focus of Delhi blast into different direction.

 

Times Now had systematically presented a particular point of view in the news 'Bangladesh Army link to Delhi blast?' to create a platform for wider 'media trial'.

 

The report said "Months after this strike in the heart of the New Delhi, the hunt for the terror masterminds continues. A doctor from Jammu and Kashmir has now emerged as the key conspirator and his interrogation adding a fresh twist to the National Investigation Agencys (NIA) case. Highly placed sources in the NIA have told TIMES NOW that in his interrogation Dr Wasim Akram Malik revealed the name of a Bangladeshi Army man, a deserter by the name of Major Yassir. According to high level sources, it was 36-year-old Major Yassir may have been the brains behind the terror strike in the capital".

 

While a highly placed source in the Research and Analysis Wing (RAW) told William's desk that that there is connection between Bangladesh army and the Delhi blast .The source also said NIA is not competent enough  to deal with foreign intelligence issues.

 

The source told William's desk that there is a strong relation between Bangladesh-India army and very recently joint military exercise held in Bangladesh. The source also told that the Bangladesh Prime minister's office special unit directly helping the RAW officials in Bangladesh on high priority issues and combating terrorism is one of the priorities

 

India is facing an enormous problem of violence, often government   attributed those to Maoists/Naxalites or Hizbul Mujahideen. But the root cause of violence in India is Indian government's own attitudes and deep-rooted systems of operation

 

Waseem's father Reyaz-ul-Hassan who is government official said "My son is innocent and has nothing to do with Delhi blast case".

 

Waseem's father said his son is innocent and on the day of the blast Waseem was in Jammu, and had drawn the cash from ATM and made shopping in various malls where CCTV cameras are present and the footage can be assessed to prove his presence in Jammu.

 

Internal security of India is facing serious threats while the government is wasting a large amount of people's tax by waging war on its people on Jammu and Kashmir. Delhi bomb blast is the naked explosion of poor crime control and law and order in India.

 

Waseem's case is not an isolated case which was plotted by Indian government with the help of the corrupted judiciary and law enforcement agencies. In the process notable numbers of corporate media played a successful role and help the forces  in plotting 'media trial'.

 

Afzal Guru, a Kashmiri who was convicted of conspiracy in the December 2001 attack on the Indian Parliament and was sentenced to death by the Supreme Court of India in 2004, did not receive a fair trial and was subject to a frame up of corrupt and inefficient police work.

 

Now Indian government finds out another Afzal Guru and corrupt and inefficient Indian police is framing false charges.

A top activist tied to one of the most notorious Islamist political organizations co-hosted a re-election fundraiser last month for U.S. Sen. Bill Nelson.

Details about the Florida Democrat's Oct. 22 fundraiser in Ocala are sparse—limited mostly to what Ahmed Bedier, former Council on American-Islamic Relations (CAIR) Tampa director, posted on his Facebook page. He published a series of pictures under the heading "Hosting Senator Bill Nelson." Those pictures showed Nelson, microphone in hand, addressing supporters as Bedier stood just behind him. The fundraiser was held in the home of a doctor named Manal Fakhoury.

Bedier remains closely tied to CAIR, a group linked to a Hamas-support network by evidence in the federal prosecution of a Texas-based Hamas charity called the Holy Land Foundation. Exhibits showed that CAIR was created as an arm of the "Palestine Committee, created to help Hamas politically and financially.

That evidence prompted the FBI to break formal communication with the group, despite its high profile position as a self-anointed voice of Muslim Americans.

One week before the Nelson fundraiser, Bedier served as master of ceremonies at CAIR's national banquet in Washington, D.C. "I am at the CAIR National Banquet," he wrote in an Oct. 15 Twitter post. "[C]an you make a donation?"

During the banquet, Bedier referred to the new memorial on the National Mall honoring Martin Luther King, envisioning a day in which "there's going to be a monument for some of these leaders at CAIR in Washington, D.C. that's going to be celebrated for generations to come."

The event raised $400,000, CAIR officials claim. Bedier hosted past national banquets for CAIR and has provided a similar service for some of its chapters.

It is not known how much Nelson's campaign for a third term in the United States Senate collected at the Ocala fundraiser. Campaign finance reports for this quarter are not due until January.

Nelson did not know about Bedier's relationship with CAIR, officials in his Senate and campaign offices said. And they indicated Bedier's postings misrepresent his relationship with Nelson.

"Sen. Nelson has met, talked to, shaken hands with or posed for a picture with thousands of people at all kinds of events," an official in Nelson's Senate office said. "We're in the age of Facebook, Youtube and Twitter, and people are able to post just about anything they want."

Nelson and Bedier "have never worked together," the official said. But Bedier was listed on the host committee for the fundraiser and did speak to the audience. That was at Falhoury's invitation, the Nelson staff said. The campaign denied a request from the Investigative Project on Terrorism for a copy of the invitation or for a list of host committee members.

Rather than check out the names on the invitation list, the campaign checks out donors before accepting their money, the Nelson campaign staffer said. Bedier's $500 contribution was rejected "because the campaign learned of some highly controversial statements about Israel attributed to him. The statements aren't reflective of Sen. Nelson's long-held views and support of Israel."

Bedier has praised Nelson a few times in recent years, starting with a controversial 2006 trip to Syria by the Florida senator. The visit generated criticism because it clashed with the Bush administration policy of isolating Bashar al-Assad's regime due to its support for Hamas and Hizballah.

That year, Bedier told a local newspaper that his CAIR chapter was working with Nelson's office to help dozens of people get out of Lebanon during fighting between Israel and Hizballah.

But Bedier's interest in Nelson may have more to do with his run-ins with a Republican challenger.

"Raising money for Senator Nelson so he can kick Adam Hasner's butt," Bedier posted on his Facebook page. Hasner, a state representative, is among four Republicans vying for their party's nomination to challenge Nelson next November.

The episode shows that Nelson is unconcerned about who fills his campaign war chest, said Rick Wilson, a campaign consultant for the Hasner campaign. But "the details are almost not as important as the fact that Bill Nelson has been a vocal and unapologetic supporter of Barack Obama's hostile policy toward Israel," Wilson said.

Bedier and Hasner's history starts with Hasner's opposition to Bedier's Florida Muslim Capitol Day in 2009. Bedier's CAIR connections were among the issues Hasner raised at the time.

Bedier now runs United Voices of America, a non-profit organization that offers leadership training and grassroots organizing programs to get more minorities, especially Muslims, involved in politics.

Nelson was photographed with Bedier during a Capitol Leadership Academy organized during the summer by Bedier's new organization. Nelson didn't know about United Voices, but understood from Fakhoury that it was a student leadership trip, an official in the Senate office said. Fakhoury has served as United Voices board chair.

Nelson "receives a lot of requests like that. He dropped by and said hello to the kids in the U.S. Capitol's visitor center. Mr. Bedier was with that group."

The visit also drew Democratic representatives John Conyers and Bob Filner along with Republican Sen. Rand Paul.

But while that program may seem politically neutral, Bedier has a history of minimizing terrorist connections and denying Islamist radicalism fuels terrorism.

He came to prominence during the prosecution of Sami Al-Arian for supporting the Palestinian Islamic Jihad. Al-Arian would plead guilty to conspiring to provide goods and services to the terrorist group. Among Bedier's statements:

o    The case was not about the Al-Arian's connection with the Palestinian Islamic Jihad, but rather, it was "an effective tool to silence anti-Israeli views in the country," he told the Christian Science Monitor in 2003. "People are afraid to speak up because they don't want to get into trouble."

o    He would not answer when asked at a press conference about CAIR's position toward the Palestinian Islamic Jihad or the U.S. designation that it is a terrorist group.

o    During an appearance on a Tampa television station, Bedier was asked if Al-Arian "was associating with the Palestinian Islamic Jihad, doesn't that seem immoral, in your opinion?" Bedier replied, "To a certain degree. Now, before 1995 there was nothing immoral about it." Later he backtracked, saying he meant there was nothing illegal about supporting the terrorist group prior to 1995.

Evidence unveiled during his trial showed Al-Arian served on the Jihad's governing board. He wrote a letter soliciting money after a double suicide bombing "so that operations such as these can continue" and was introduced as far back as 1991 as the head of the Jihad's "active arm."

Despite all this, Bedier traveled the country to host CAIR-sponsored screenings of the documentary sympathetic to Al-Arian.

More recently, in a November 2009 appearance on Tampa television, Bedier denied the Fort Hood shooting by Army psychiatrist Nidal Malik Hasan was a terrorist act and argued that Hasan's radical Islamist views should not be considered factors. By the time the show aired live, media reports showed that law enforcement already had linked Hasan to American-born al-Qaida cleric Anwar al-Awlaki and that Hasan printed "SoA," or soldier of Allah, on his business card. He gave a 2007 presentation in which he said it was "getting harder and harder for Muslims in the service to morally justify being in a military that seems constantly engaged against fellow Muslims." He told classmates he was "a Muslim first and an American second."

To Bedier, however, any discussion of a religious motivation in the shooting death of 13 people at Fort Hood was out of bounds. "I reject the concept that Islam has anything to do with this because anybody, regardless of your religion, I mean, this is not the first time a soldier has turned and killed his own people," he said.

In August, Bedier questioned whether an attack in southern Israel should be considered a terrorist act because the casualties included Israeli soldiers. The comments came on "True Talk," a weekly program Bedier hosts on a community radio station.

"Well if it is an attack on soldiers, then it could be an act of war, but is it necessarily a terrorist attack and are all attacks on soldiers terrorist in nature?" he asked. "I guess I gotta look up the definition of terrorism and if Israelis or if the world believes or if it defines attacks on soldiers as terrorist attacks as well."

In the attack, gunman opened fire on buses and cars, and then detonated explosives as Israeli troops arrived. Six of the eight people killed were civilians.

After learning about the civilian casualties, Bedier backed off, but criticized Israel for retaliating against targets in Gaza. "When criminals act here and they go and kill somebody, they don't go and bomb their neighborhood. They go arrest him and they put him on trial. They go do an investigation. They don't immediately retaliate within a couple of hours by taking out their family."

Nelson's campaign said it knew nothing of these comments when Bedier's name was included on an invitation to his Ocala fundraiser, and that Nelson did not know Bedier or his controversial reputation.

Hasner's campaign argued that Nelson's laissez faire approach stopped only when questions were raised.

"If he hadn't been called on it," Wilson said, "he wouldn't have done anything about it."

There has been much said this election about how the Republican presidential candidates are all talking like Ron Paul. Well, last night, in the midst of yet another Ron Paul impression, Rick Perry couldn't even talk. To make matters worse, Perry looked to Paul to bail him out.

For mercy's sake, perhaps Ron should coach Rick before Saturday night's debate in South Carolina: "Here are federal departments that should be cut… here's why… here's how… now let's look up 'conservative' in the dictionary… good, Rick, good… Now let's take a look at this thing called 'The Constitution'… that's right Rick, it's the charter that outlines the delegated powers of our federal government… that's right Rick, all of the departments we just discussed aren't in it… that's right, it is also the document everyone takes an oath to uphold after election day… why doesn't everyone follow it? That's a good question Rick… but at least you're finally grasping this, good job…"

In fact, Paul should probably be coaching the entire Republican field, none of whom have yet to offer any substantive government cuts­particularly that eliminate specific federal departments.

At least Rick was trying.

I've dinged Mitt Romney for his less-than-stellar record on healthcare, his weakness on Social Security reform, and his reprehensible support for ethanol subsidies, but I haven't bothered to address his budget plan – in part because it seemed rather underwhelming.

Sounds like I haven't missed much. Jacob Sullum has done the tedious work of reading through Romney's plan, and he is unimpressed.
Mitt Romney said he wants to "eliminate every government program that is not absolutely essential." That sounds good until you realize that Romney's goal of cutting $500 billion from projected federal outlays in 2016 would, at best, leave the budget about 8 percent higher than it is now and only 11 percent lower than it would be without any attempt to restrain spending. The implication: Mitt Romney thinks 89 percent of what the federal government does is "absolutely essential." And that's what he says when he is trying to appeal to the fiscally conservative Republicans whose votes he will need to win his party's presidential nomination. Who knows what he really thinks, assuming he has any firm convictions at all on this crucial question. …By contrast, the plan outlined by Rep. Ron Paul (R-Texas), one of Romney's rivals in the race for the Republican nomination, would balance the budget by 2015. Clearly, Paul's idea of "absolutely essential" government programs is a bit narrower than Romney's. But whose isn't?
Jacob's analysis is on the mark, and he doesn't let Romney get away with the business-as-usual Washington scam of claiming that a reduction in the projected growth of spending is actually a spending cut. Using honest math rather than DC math, Romney's budget plan (assuming he is serious) would increase spending by 8 percent over the next four years.

To be fair, a budget that allows federal spending to jump by 8 percent over the next four years would satisfy Mitchell's Golden Rule. Barring an unexpected downturn, the private sector would be growing faster than the government.

The problem is that even good politicians usually fail to fulfill their campaign promises. So if a politician today is saying that he will let spending climb by about 2 percent each year, that probably means it will increase 5 percent each year.

And if he isn't proposing to eliminate a single cabinet-level department, that doesn't suggest a strong commitment to fiscal responsibility.

It also means Mitt Romney thinks the Department of Housing and Urban Development is "absolutely essential."

یہ لوگ چیزیں تو پیدا کر تے ہیں مگر اپنی عوام کو پریشانی میں مبتلا کرنے کے لئے ان کا استعمال بھرپور طریقے سے کرتے ہیں آ ج ملک کی کسی بھی مارکیٹ اورکسی بھی چیز کی جانب نظر ڈورائیں ہر طرف مہنگائی کا سیلاب اس جمہوری دور حکومت میں عوام کو ڈس رہا ہے آ ج سے 3/4سال قبل جوچیز10روپے کی ملتی تھی آج وہ 30/40میں بھی بمشکل ملتی ہے اس کے لئے آ ٹے اور چینی کی مثالیں ہی کافی ہیں کیو نکہ چینی 28روپے فی کلو اورآٹا 12 روپے فیکلو عام مارکیٹ میں با آسانی اور وافر مل جا تاتھا مگر آ ج یہی چیزیں 80/روپے اور32/روپے فی کلو کے حساب سے بمشکل مل رہی ہیں اگراسی طرح پٹرول، ڈیزل اورمٹی کے تیل کی بات کی جائے تو وہ بھی اپنی حدوں کو چھو رہے ہیں اور ملک اسی مہنگا ئی کے زیر اثر ہیجس کی وجہ سے اس بار بھی سنت ابراہیمی اداکرنے والوں میں بے تحاشا کمی واقع ہو ئی ہے جو لوگ شاید پچھلے سال سنت ابراہیمی ادا کر چکے ہیں وہ بمشکل اس سال اس سعادت کے فریضہ کوسر انجام دے سکیں گے اس مہنگا ئی کے دورمیں وہ صرف قیمتیں پوچھ کر واپس جا تے نظر آئے ہیں گاہک تاجروں پر زیادہ قیمتیں وصول کر نے کادعوی کرتے ہیں تو تا جر عوام کو ''صرف باتوں سے دل بہلانے والے '' کہہ کر ٹالنے میں مصروف عمل ہیں اورمنڈی والوں کوبھی اس مہنگا ئی کاذمہ دار قرار دیتے ہیں بقول ان کے سیلاب میں ہزاروں جانوروں کاضیاع ہوا ہے اس لئے ان کی قیمتوں میں یہ اضا فہ دیکھنے میں نظر آ رہا ہے اوراوپر سے منڈی والے بھی زیادہ فیس وصول کرتے ہیں اس کے ساتھ ساتھ وہ یہ تجویز بھی دیتے ہیں کہ اگرجانوروں کی سپلائی ڈ بل کر دی جائے اورمنڈی کی فیس بھی کم کر دی جائے تو امید کی جاسکتی ہے کہ زیادہ لو گ سنت ابراہیمی کو ادا کر نے کے قابل ہو جائیں گے اور اس طرح تصویر کا دوسرا رخ دیکھیں تو مہنگائی کارونارونے والی عوام سے آج بازاروں میں بے پناہ رش نظر آ رہاہے اور وہاں تل دھرنے کوجگہ نہیں مل رہی اسکے ساتھ ساتھ یہ بات بھی سامنے آتی ہے کہ آج سنت ابراہیمی کا مقصد صرف ذاتی اناکی تسکین اور ذاتی تشہیر کا ذریعہ بنا دیا گیا ہے آ ج قربانی کو سنت ابراہیمی سمجھ کر ادا نہیں کیا جاتا بلکہ صرف خود ی کی تشہیر کے لئے استعمال کیا جا تا ہے اور گوشت کی ''تقسیم'' بھی ''تعلق'' اور''خاندانی رسم و رواج'' کے مطابق سر انجام دی جاتی ہے اہم ،خصوصی تعلق داروں اور''اونچے'' گھرانوں کواچھے اور بہترین گوشت سے نوازہ جاتا ہے اور ان کی گھر میںآمد کے بعد خوب خاطر مدارت بھی کی جا تی ہے جب کہ اس قربانی کے حقیقی حق داروں کویا تو ٹرخادیاجا تا ہے یاپھر اس گو شت سے نوازہ جا تاہے جوخود کھا نے سے ''صاحبِ قربانی'' عا جز ہو تا ہے مطلب اس گوشت کی تقسیم کرتے وقت بھی اس گوشت کو آپس میں مکس(ملایا ) نہیں جاتا بلکہ ہر بہترین حصے کو یا تو اپنے فریج میں''فریز'' کر لیا جاتا ہے یا پھر اہم لوگوں کو ''تحفے'' میں اوراپنی بڑائی جتلانے کے لئیستعمال کیا جاتا ہے یہ ہماری قوم کی اجتماعی بے حسی اور سنت ابراہیمی کے متضاد کام کر نے کی زندہ جاوید مثال ہے جب کہ لوگوں کوایساہرگز نہیں کرناچاہیئے کیونکہ ایک ایک قربانی کا حساب روز آ خرت اللہ تعالیٰ کودینا ہے اور اپنے دین پر عمل پیرا ہوتے ہوئے قربانی کے فرائض کو اداکرنا چاہیئے کیو نکہ خدائے بزرگ وذوالجلال کا واضع ارشادہے کہ ''مجھ تک تمھاری قربانی کا گوشت، خون اور کھالیں نہیں بلکہ تمھاری نیتیں پہنچتی ہیں'' آج اسی ارشاد پر عمل پیرا ہوکر اپنے لئے روز آخرت کے لئے سرخروہو نے کے لئے کام کر نا چاہیئے اوردین میں جسطرح قربانی کے فرائض اورسنتوں پرعمل کرنا بتایا گیا ہے اسی پر عمل پیرا ہو کر غریبوں، مسکینوں، محتاجوں، حقیقی ضرورتمندوں، رشتہ داروں، اورخوداپنے گھر والوں کے لئے گوشت تقسیم کرنے کا جو طریقہ بتا یا گیا ہے اس پرعمل پیرا ہو نا چاہیئے
اور اگربحیثیت قوم اورایک فرد ہم اس پر قائم نہیں تو ہمیں اجتماعی طور پر آ ج یہ سوچنے کی ضرورت ہے کہ آج ہم جسطرح اور جس سوچ سے قربانی کی سنت ادا کر رہے ہیں کیا یہی وہ درس تھاجوہمیں حضرت ابراہیم
ؑ اور حضرت اسماعیل ؑ نے قربانی کے حوالے سے دیاتھا یا آ ج ہماری قربانی سے روح ابراہیمی نظر آ تی ہے جواس وقت حضرت ابراہیمؑ اور حضرت اسماعیل ؑ نے ادا کی تھی ہمیں بھی اپنی قربانی کو اسی کے مطابق ڈھالناہوگا اور اگر ایسا نہیں تو ہمیں اپنے اعمال اور اپنے کردار پر نظر ڈالتے ہو ئے سب سے پہلے اپنے گریبان میں جھانکنا ہوگا تا کہ خود دین پرعمل پیرا ہو کر اپنی قربانی کو قربانیکی روح کے مطابق اداکر سکیں اور آخرت میں یہ ہمارے لئے بخشش کاذریعہ بن سکے ****

**JP** Cash shortage threatens Pakistan flood aid

Western aid agencies in Pakistan warned that they might have to halt flood relief efforts in the cash-strapped country because of funding shortfalls.

Floods in August hit Sindh province in the south, killing at least 430 people and disrupting the lives of nine million. Many people are still camping out in the open with little food, water or shelter.

Western aid agencies made an urgent appeal for $357 million in September, but only 23 percent of that has been secured.

If more cash doesn't arrive soon, aid agencies such as Oxfam, Save the Children and Care may be forced to leave flood victims to fend for themselves.

Aid agencies fear flood victims could suffer from a major outbreak of dengue fever, malaria and acute respiratory infection.

"The sort of things that we're really concerned about are those very basic humanitarian essentials like access to clean water and sanitation which over 60 percent of the affected population at the moment still don't have access to," said Oxfam's Country Director in Pakistan, Neva Khan.

"If we can't ensure clean water to as many people as possible, the risk of all these things increasing and causing a public health crisis is a key concern."

Aid agencies have said Pakistan's image of a haven for Islamist militants - especially after US special forces found and killed Osama bin Laden in a Pakistani town in May - have made it a "bad brand" to sell to global donors.

While a combination of factors - donor fatigue, the global financial slump, competition from other crises such as the East African famine - have all played a part, geopolitics and security remains one of Western donors' major concerns. The UN says the floods have wiped out massive swathes of agricultural land, killed thousands of livestock and destroyed food stocks in Sindh. The government is in no position to step in because the South Asian nation's economy is weak and heavily dependent on foreign aid. It has yet to care for some 800,000 people displaced by last year's floods. Hardships are likely to increase as winter approaches.

Investigator: Herman Cain innocent of sexual advances

ATLANTA (CBS ATLANTA) -

Private investigator TJ Ward said presidential hopeful Herman Cain was not lying at a news conference on Tuesday in Phoenix.

Cain denied making any sexual actions towards Sharon Bialek and vowed to take a polygraph test if necessary to prove his innocence.

Cain has not taken a polygraph but Ward said he does have software that does something better.

Ward said the $15,000 software can detect lies in people's voices.

CBS Atlanta's Mike Paluska played Cain's speech for Ward into the software and watched as it analyzed Cain's every word.

If he is hiding something this thing would have spiked way down here," said Ward. "He is being truthful, totally truthful. He is a man with integrity and he talked directly about not knowing any incident he is accused of."

The software analyzes the stress level and other factors in your voice. During the speech, when Cain denied the claims, the lie detector read "low risk." According to Ward, that means Cain is telling the truth.

During the section of Bialek's news conference where she says, "He suddenly reached over put his hand on my leg under my skirt and reached for my genitals he also grabbed my head brought it towards his crotch."

During the analysis of that section the software said "high risk statement." Ward said that means she is not telling the truth about what happened.

"I don't think she is fabricating her meetings," said Ward. But, she is fabricating what transpired."

Ward said nearly 70 law enforcement agencies nationwide use the voice software, including the Forsyth County Sheriff's Office.

Ward said the technology is a scientific measure that law enforcement use as a tool to tell when someone is lying and that it has a 95 percent success rate.

After listening to Cain's speech and analyzing it, Ward said there is no doubt, Cain is innocent.

"When he directly talks about the allegations against him there is no high risk," said Ward. "It is low risk, which tells me he is being truthful in his conversations to the public."

Herman Cain's Enron-esque Disaster
The story the GOP presidential candidate won't tell you about his years in corporate America.

What GOP presidential contender Herman Cain lacks in political experience, he likes to say, he makes up for with decades' worth of success in corporate America. He climbed the corporate ladder at the Pillsbury Company, chaired the Federal Reserve Bank of Kansas City, and rescued the failing Godfather's Pizza franchise. That business-centric message has won Cain his share of admirers: a focus group convened after a recent Fox News presidential debate overwhelmingly declared Cain the winner.

"I think that over 40 years of business experience is resonating a lot more with people than simply having political experience," he said on a recent Iowa visit. "Knowing how Washington works isn't necessarily an advantage. As a businessman going in, I don't want to know how Washington works. I want to change Washington D.C. and so by not knowing how it is supposed to work I can ask tough questions that will help change the culture."

Cain clearly believes that his pro-business message is what GOP voters want to hear. So much so, in fact, that on Saturday he officially unveiled his candidacy for the 2012 GOP nomination. But scrubbed from Cain's official story is his long tenure as a director at a Midwest energy corporation named Aquila that, like the infamous Enron Corporation, recklessly dove into the wild west of energy trading and speculation­and ultimately screwed its employees out of tens of millions of dollars.

According to five lawsuits filed in federal court in 2004, Aquila's board of directors­which Cain joined in 1992­allegedly steered employees into heavily investing their retirement savings in company stock. At the same time, the company shifted its business model from straightforward energy generation to risky energy trading, an unregulated market made infamous by now-defunct Enron. The suits, later folded into a single, massive class action ( PDF), alleged that Cain and top company officials violated a 37-year-old federal law requiring that employers manage employees retirement programs responsibly. (Cain's presidential exploratory committee did not respond to a request for comment.)

Founded in 1917 as Green Light and Power, Aquila traditionally made its money operating electric and gas plants and selling the energy they produced. In the years after Cain joined the board, Aquila's earnings climbed, from $254 million in 1995 to $351 million in 1998. Then, in early 1999, the company's leadership decided running power plants wasn't lucrative enough; energy trading and speculation had grown popular, and as the class suit lays out, Aquila wanted a piece of the action.

It was a dangerous move­as a company spokesman later put it, "the risk was huge." In the end, it proved disastrous. Aquila's decision to join Enron, Reliant Energy, and the other heavy-hitters in the energy trading markets would ultimately wipe out 94 percent of Aquila's stock value between 1999 and 2004. The company also faced criticism for using some of the same trading tricks that Enron did as a way to puff up its stock price, the lawsuit says. That included using "roundtrip" trades, a scheme in which Aquila would sell a trading partner some energy and then that partner would sell the same amount back to Aquila, a deal that canceled itself out. In the end, nothing actually changed hands. But it boosted Aquila's trading volume and revenue, sending a positive signal to the markets. The company also engaged in megawatt laundering, or "ricochet" trading, the lawsuit alleges. In such transactions, Aquila and other companies would buy energy from California at a lower capped price, move that energy out of the state, then re-sell it back to California at a higher price for a tidy profit.

But this financial trickery couldn't save a listing ship. In 2002, Aquila teetered on the brink of collapse. And for Aquila's employees, the result of the company's foray into energy trading was devastating: The company's employee retirement fund, overseen by the board of directors, lost more than $200 million in 2002. The reason: At the same time Aquila's executives and directors were investing more and more in highly risky energy speculation, they were selling their employees on the conservative nature of Aquila and pushing them to invest their retirement savings in company stock.

For years, the lawsuit says, executives urged employees in company speeches to reinvest in Aquila, lauded those who did so as "Aquila partners," and even offered a 15 percent discount to buy company stock. Executives and board members also made it more difficult to sell off company stock by implementing lock-up periods, during which employees couldn't cash in their holdings. At the end of 2000, 85 percent of Aquila employees owned common stock in the company. What's more, 60 percent of the employees' retirement fund consisted of Aquila stock­even though financial experts say that total should never be more than 10 to 20 percent.

The spectacular failure of Aquila's trading venture practically wiped out the hard-earned retirement savings of veteran employees. Richard Itteilag, a plaintiff in the Aquila class action, lost 87 percent of his savings. Robert Goodson, a 20-year Aquila employee, lost 75 percent. Michael Reinhardt lost a staggering 94 percent. All told, thousands of employees saw their retirement funds eviscerated thanks to Aquila's Enron-esque activities. (In 2007, Aquila settled with the employees for $10.5 million. Not long after, Aquila merged with other Midwestern energy companies and now no longer operates as Aquila.)

Cain served on the board of directors throughout Aquila's ill-fated trading misadventure and the subsequent collapse of the company's retirement fund. In fact, he chaired the board's compensation committee, which, according to the lawsuit, had direct oversight of the push to get employees to invest more and more in Aquila stock. As chair of the compensation committee, Cain also saw fit to dole out $30 million in bonuses, not including stock options, to the top five execs at Aquila in 2002, with the company's stock plummeting. A month after the Kansas City Star reported on the hefty bonuses in July 2002, the company laid off 500 employees, and the losses to employees holding company stock had reached hundreds of millions of dollars.

As a board member, Cain would've had direct knowledge of Aquila's activities, says Fred Taylor Isquith, a New York attorney who litigated the employee class action. Asked if it was fair to place blame on Cain for the debacle at Aquila, Isquith replied, "Yes, I believe it is."
