What Does 'Class Action' Mean?

The news of the Supreme Court decision on Wal-Mart -- declining to approve a massive lawsuit against an amazing company -- was reported as if it amounted to some devastating blow to American life. Nonsense: the decision actually permits normalcy in economic development to proceed without a new round of destruction of wealth. Some lawyers might be sad, but it is great for the rest of us.

The lawsuit grouped the interests of 1.6 million women who had worked for 3,400 stores since 1998. One can only imagine the looting that would have commenced had the decision gone the other way. It would have been catastrophic. What the Supreme Court did was narrowly decline to wreck even more American labor markets and the gears of free enterprise. It is a small favor, but thank goodness for it.

The lawsuit that was turned back was called a "class-action lawsuit." The word "class" is the English lexicon is usually used in two ways.

The first is the popular sense that refers to social standing. A person can be from the "working class." A person can be part of the "middle class." In American society, there is by tradition no such thing as an "upper class." There might be a "leisure class" or an "upper middle class" or an "upper crust" but no "upper class" -- and that probably stems from the charming myth that we abolished such a thing with the elimination of Lords and Dukes.

A derivative sense of the term class is more colloquial. We say that a person "has class," which means that he or she acts and behaves in ways that are generally higher on the social strata than the norm. We might say something is "classy," meaning pretty, beautiful, impressive, or suggestive of wealth and opulence.

This is not the sense in which the term class is used for these lawsuits. The second definition is the relevant one and it is mostly drawn from academia and the Marxist tradition in particular. The Marxist theory is that all of society is constantly seething in conflicting and exploitative social relationships that pit group against group.

In Marx's view, the core economic conflict was labor versus capital. The idea is that capitalists exploit the workers by sucking the surplus value of production from them such that capital grows ever richer and labor ever poorer. The guy built an entire system of thought based on this idea and it has inspired revolutions around the world.

It's all a bit strange because it is so obviously untrue. If I hire you to mow my grass, you are not being exploited. We are cooperating in mutually beneficial exchange. No one has a gun to your head and we both are free to negotiate the terms of the deal. You can work for anyone who wants to hire you and I can hire anyone who is willing to work for me. This is called peace and exchange; there is nothing exploitative about it.

Marx was just brewing buckets of envy in a time when people were confused about the accumulation of capital and confused about demographic movements and the like. His theory explained nothing and was based on nothing, but somehow it stuck and it still festers, inspiring governments and theorists around the world to try to reinvent Marxism.

One reinvention of Marxist theory is the idea that the gains of whites come at the expense of blacks, or that the gains of men come at the expense of women, or that the gains of abled people come at the expense of the disabled, or that the gains of people in general come at the expense of the environment. They all assume that there is something like a class of people whose interests and outlook are homogeneous in every sense that matters.

This is obviously not the case with the people who joined -- or who were joined without their permission, in the usual way -- the "class action lawsuit" against Wal-Mart. First, there is no such thing as the interests of women -- or of men, or blacks, or disabled people or the environment. Interests are always radically heterogeneous because the world is filled with unique individuals with subjective perspectives, ideas, and experiences.

Second, there was no class "acting" in this case. It was a bunch of lawyers using some former Wal-Mart employees -- let's just say that these people were being exploited by attorneys -- in the attempt to pick the deepest pockets around. Had the lawsuit been won, the women would have received settlements that would pay a day of parking meter fees. The lawyers would have looted it all.

The American legal system should never let such a ridiculous lawsuit make any headway in the court system at all. If we had strict property rights, freedom of association and exchange, and freedom of contract, there would be no such thing as a class-action suit. If we had a real free market, we would be spared that massive social waste that was involved in this preposterous lawsuit.

But then what about discrimination? It comes down to this. If Wal-Mart systematically discriminated against women, there is a wonderful market opportunity open for some other company to hire up all these millions of downtrodden people and make a great killing in the market. It is for this reason that irrational and invidious discrimination is not a feature of the market economy.

There is no such thing as class in a free market. Its members are fluid and based on a huge range of economic conditions that are mostly left to human choice. Class is fluid and non-conflicting. Peace prevails.

As for the Marxist idea of class, yes, its appearance can be created but only by legislation and lawsuits that pit one group against another group. It is wholly artificial and a good example of how the state creates the very problem it purports to solve. The Supreme Court should never be asked to decide this sort of matter, but its majority opinion grants us a temporary reprieve from more looting of the capitalist class (in the best sense of that term).

The Los Angeles Times published an article last week about another travesty in the war on immigrants. Georgia farmers are having trouble finding people to pick their fruit crops. The likely reason is that Georgia's new harsh immigration law, set to take effect in July, is scaring off illegal immigrants.

The travesty is not a new one. A few years ago, California farmers had to watch their crops rot in the fields owing to a scarcity of workers to harvest them. Again, it was the war on immigrants that was dissuading workers from coming in and harvesting the crops.

A statist would respond, "Oh, Jacob, you must be mistaken. Everyone knows that illegal aliens steal jobs from Americans. Now that Georgia's anti-immigrant bill is set to go into effect, the Georgians who have had their jobs stolen from them are going to be rushing back to reclaim them."

Well, not so, Mr. Statist. It didn't happen in California and it isn't happening in Georgia. Notwithstanding a high unemployment rate in Georgia, the Times article points out, "Few here believe that native Southerners, white or black, wish to return to the land their ancestors once sharecropped or tended in bondage."

For that matter, it doesn't appear that any Americans who support the war on immigrants or who purport to love the poor are rushing to help the farmers whose blackberry crops must be harvested right away.

Let's analyze the issue from a libertarian perspective.

The farmers own and operate their farms, just as they own any money they have in the bank for operating expenses. As owners, they have the moral right to do whatever they want with their property and their money. That's what private property is all about.

The farmers also have the moral right to associate with anyone they want. That's what freedom of association is all about.

The farmers also have the right to entered into any mutually beneficial economic arrangement with anyone else. That's what economic liberty, freedom of contract, and free enterprise are all about.

The immigrants have the moral right to sustain and improve their lives through labor. They have the moral right to travel and move. They have the moral right to enter into mutually beneficial economic arrangements with others. They have the moral right to accumulate wealth and do whatever they want with it. That's what self-ownership and economic liberty are all about. They also have the moral right of freedom of association.

For years in Georgia, as elsewhere across the country, farmers and illegal immigrants had been entering into what they both considered to be a mutually beneficial arrangement. The farmer used his money to make a wage offer to the immigrant. The immigrant, in turn, would decide whether he wanted to accept the offer or go elsewhere.

If a deal was struck, both sides benefitted because they both were giving up something the valued less for something they valued more. The farmer was giving up money for wages in return for the prospect of high profits on the sale of the crops. The worker was giving up his time and energy in return for the money he was receiving from the farmer.

The agreed-upon wage was far above what the worker would receive in Latin America. Many times, he would send a large portion of his wages back to his wife and kids or parents or other family members back home. What better way to help the poor than that?

Now, I ask you: What business does the government, state or national, have interfering with the exercise of fundamental rights? This is purely a private transaction between the farmer and the immigrants. It's none of the government's business.

The Declaration of Independence, which Georgians and other Americans will soon be celebrating with much fanfare, holds that all people ­ not just Americans ­ are endowed with certain fundamental, natural, God-given rights with which no government can legitimately interfere. These fundamental rights include the right to life, liberty, and the pursuit of happiness. They also include the right to private property, the right to associate with and contract with others, the right to accumulate wealth and decide what to do with it, and the right to become an owner of private property.

Wouldn't it be nice if this Fourth of July Americans were to ponder the profound words that Jefferson enunciated in the Declaration, words that expressed the mindset and sentiments of the British citizens who rebelled against their own government, in part because that government was restricting immigration into the British colonies? It wouldn't help those Georgia farmers or their consumers this year, but it could move us closer to getting American on the right road in the future ­ a road toward freedom, free markets, peace, prosperity, harmony, and moral, ethical, and Christian values.

At a time when a dollar today only has 76% of the value it did 10 years ago, it's vital that Congress return the Federal Reserve to a sole focus on its original mandate – protect the value of the dollar - in order to protect every American from the hidden tax of inflation.

The Fed should not be handing out money and picking winners and losers.

The Fed should not be printing money out of thin air in an effort to create inflation.

If we are to grow our economy, get people back to work, and create the conditions for long term economic growth, the American people must know that they are safe from the Federal Reserve degrading the value of the dollar and increasing our cost of living.

I believe that PML Q leaders by leaving their role as an opposition party have not lived up to the expectations of millions of voters who reposed their trust in them in the Feb 2008 elections. I tried to prevail upon the party leadership to change their decision, but in vain. Now the only honorable course open to me is to resign from PML membership and also as member of the National Assembly on the occasion of vote for Budget.

Abstaining from voting on the budget, would practically mean approving it, and with it, tacitly endorsing all government policies and future plans. Since I believe this coalition government is working against the interests of the people of Pakistan, my support for the budget would compromise all my struggle for the people. I cannot vote against my conscience. I have thus voted against the budget. Just like Marui in Latif Sains Shah Jo Risalo, this Marui too cannot compromise the struggle for her marooara (people.)

As I had predicted, PML Q has not been able to correct the disastrous course of this government. And they will not be able to do so in the future as well. Simply because this government has a built-in flaw: its sole objective is to protect its vested interests rather than peoples interests. It is my firm belief that the only thing that would continue in the coming months is crass, corrupt politicking to steal the next election. The real concerns of the people would continue to be neglected.

Therefore, I believe that:

-To be associated with a government, which has not followed parliaments joint resolution mandating action against NATO forces in case of drones, has bartered Pakistans sovereignty, has not protected Pakistans sensitive locations, has not kept our territory protected from foreign forces, would be a travesty.

-To be associated with a government which has allowed human rights of thousands to be grossly violated by not giving them justice, salaries, minimum wages, regularizations, jobs (Haleema, NPIW, Lady Health Workers, APP, NCHD, NEF, Lower Education Staff etc), would be subversive.

-To be associated with a government, which has taken away food and shelter from the poor, fuel from the vehicles, electricity and gas from industry and homes, which has forced people to commit suicides due to its corruption, faulty economic policies, which has forgiven the loan defaulters, which has not been austere, which has not taxed the rich appropriately including inequitable taxation for agriculture and industry, would be criminal.

-To be associated with a government, which has been completely negligent in its primary responsibilities during natural and national disasters like Attabad lake, the recent floods, the Abottabad crisis, the complete break down of law and order in all of Pakistan, would be perfidious.

-To be associated with a government, which has abysmally failed to protect its own constitutional office holders, security forces, religious sects, minorities, media and most importantly therefore innocent people from kidnappings, targeted killing and terrorist attacks, which is fighting a directionless war and is compromising with criminals, would be atrocity.

-To be associated with a government which has allowed Pakistans image to be trashed internationally, has practically abandoned the valiant people of occupied Kashmir, has let national sovereignty to be chipped away, has not managed its relations with friendly countries like China at its optimal, has not handled the Indian threat with firmness and dignity, has done nothing to counter growing campaign against Pakistans nuclear assets, would be treacherous.

-To be associated with a government which has used provincialism as a political tool, which has has not resolved border commission dispute on Diamir dam, has not fulfilled its promises in Agaze Huqooqe Balochistan or KPK financial revival package or FATA Reforms, has not fulfilled its rehabilitation commitments for earthquake 2005 victims, has not fulfilled provincial quota obligations, has discriminated between rural-urban and head-tail for water, has not held anyone accountable in mishaps like the Airblue crash, has not resolved inter-provincial water disputes in line with 1991 Water Accord, has not passed the National Language bill accepting the rights of provinces, would be disloyal.

-To be associated with a government whose corruption, lack of meritocracy, incompetence has brought national economy down on its knees, which has mortgaged the coming generations future by mindless borrowing, shattered public sector corporations, retarded industrial production, hammered the small farmer and has pushed half the population in the depths of wretched poverty, would be a perversion.

-To be associated with a government, which has willfully clashed with the judiciary, has dragged its feet on the Accountability Bill and the bill to prosecute terrorists, and has rendered parliament irrelevant, forcing thousands like myself to get justice from Judiciary versus parliament would be treasonous.

-To be associated with a government that is run by thugs and commission-mafia, who have lined up their pockets with development funds, deprived people of their fundamental rights such as clean water, schools, health centers, roads, electricity, gas, would be shameful.

It is time that the people of Pakistan are freed from this government. It is time that sincere, tax-paying Pakistanis unite for Pakistans sake. It is time they reject old politics and espouse new politics, where the definition of politics is serving ones people rather than ruling over them. For the above reasons I hereby tender my resignation for the sake of the people of AJK, Balochistan, GB, KPK, Punjab, Sindh my Pakistan.

I intend to honor my oath by educating my people on the dangers of supporting a corrupt, inefficient and self serving government that is happily allowing our homeland to descend into chaos. I want to impress upon my people through my Karavan-e-Haq, that they dont have to accept a government that robs them daily. That they have a right to clean governance, and that their destiny is in their own hands.

I intend at all times to honor my flag, continuing my humble struggle for Haq and providing Pakistan with the leadership that can make it a just, moderate, and developed country.
