Gee, after Holder's stellar performance handling Ahmed Ghailani's show trial last month (in which Ghailani got away with murder), you would think that Holder would have come to the rational conclusion that enemy combatants have no place in civilian courts.  Of course, never let it be said that Holder is rational---or even sane...

Attorney General Holder is urging the Senate to drop a provision in a spending bill that passed the House on Wednesday that would ban transfers of Guantanamo Bay prisoners to the U.S. — effectively scuttling the prospects for a civilian trial for Khalid Sheikh Mohammed and other alleged Al Qaeda operatives currently at the island prison run by the U.S. military.

In a letter to Senate leaders, Holder called the provision "an extreme and risky encroachment on the authority of the Executive Branch." There was no immediate indication from the White House whether President Barack Obama finds the Gitmo-related limit so objectionable that he would veto the continuing resolution funding the government through September.

"This provision goes well beyond existing law and would unwisely restrict the ability of the Executive Branch to prosecute alleged terrorists in Federal courts or military commissions in the United States as well as its ability to incarcerate those convicted in those tribunals," Holder said in the letter, sent Thursday to Senate Majority Leader Harry Reid (D-Nev.) and Minority Leader Mitch McConnell (R-Ky.).  "In order to protect the American people as effectively as possible, we must be in a position to use every lawful instrument of national power to ensure that terrorists are brought to justice and can no longer threaten American lives."

Holder also called the provision, which specifically names alleged Sept. 11 mastermind Khalid Sheikh Mohammed, historically unprecedented. "We have been unable to identify any parallel to Section 1116 in the history of our nation in which Congress has intervened to prohibit the prosecution of particular persons or crimes. It would be a mistake to tie the hands of the president and his national security advisers now," the attorney general wrote.

White House press secretary Robert Gibbs declined to say Thursday whether Obama would veto the spending bill if it comes to the White House with the Guantanamo-to-U.S. transfer ban  in place. "We would make any decisions about signing that after it's been through the legislative process," Gibbs told reporters.

The restriction would appear to allow military commissions trials for Guantanamo prisoners at Guantanamo Bay or other locations outside the U.S. The administration could also decide to continue to hold such prisoners without trial under the laws of war. Holder said last month that the administration was "close" to remaking a decision about where to try KSM and others allegedly involved in Sept. 11. An initial plan to try them in federal court in Manhattan was abandoned by the administration earlier this year due to local opposition.

It's not clear why Holder wrote only to Reid and McConnell and not to House leaders in advance of yesterday's vote. However, the text of the House bill was available only a few hours before the vote. The spending bill passed 212-206 with 35 Democrats and all voting Republicans opposing the measure. No motion to strip the provision was permitted under the hurry-up rules being used in the lame-duck session.

I support killing DADT, but more importantly, the outright ban that
preceded it, recodified by democrats overwhelmingly.

The 9th Circuit Court (yes, THEM!) just did that in one swell foop,
and Obama is challenging it. Let it go and DADT ended 3 months ago!

Because I am opposed to those individuals who put what they do in the bedroom at the forefront of their lives;  in other words,  because I am opposed to those individuals that define their very existence by their sexuality,  this does not make me a "Homophobe".

I am opposed to those militants who are attempting to force their sexuality upon me, and the rest of America.   I am opposed to parades in front of children with you donned in assless chaps, boas, and/or dressed as the Statute of Liberty.   I am opposed to you, and any other group or entity demanding more rights than what the rest of Americans enjoy, because of who you sleep with.
 
You are correct, that there have been Gays in our United States military since 1776.   None of them chose to get out and parade around,  announcing who it is that they are boffing or honking on.   This is how it should be.

graduate from the Central Intelligence Agency (CIA) into the
presidency and bring lessons learned at CIA headquarters directly into
US policy. While serving under Ronald Reagan, helped encourage the
Iraq-Iran war, resulting in deaths of one million people, allowing US
oil and arms dealers to profit greatly.  During the 'Eighties, helped
encourage US sponsored military dictators in Latin America, guilty of
extermination of thousands of ordinary citizens, via US-trained "death
squads."  Conducted pre-emptive war with Panama, resulting in
1,000-4,000 deaths, simply to topple former CIA henchman and drug
lord, Manuel Noriega. Elder Statesman, walking around freely today,
basking in limelight.



George W. Bush. Two term US president, elected using electronic,
"black box" voting methods that permit no verification of actual vote
count. Conducted two pre-emptive wars, resulting in excess of 100,000
US. Iraqi and Afghani deaths.  Condones the use of torture as US
policy. Condones rejection of the Geneva Convention, becoming the
first US president to openly do so. Considers the US Constitution "A
Goddamned piece of paper." Embattled Statesman, walking around freely

Dick Cheney. Former US Secretary of Defense, and signator of the PNAC,
and current Vice President. Accused mastermind of the 911 "terrorist"
attack against the US (unproven), Cheney has been called "The Vice
President For Torture" by the Washington Post. A staunch supporter of
the Middle Eastern War Without End, Cheney, like Wolfowitz and
Rumsfeld bears particular responsibility for the conduct of the war.

Ron Paul to oversee The Federal Reserve

Ben Bernanke is pissing all over himself. Ron Paul (R-Tx) has been calling for an audit of The Federal Reserve for years. It's time to expose American taxpayers to the truth about what the Fed has done with our money and who has benefitted from their monetary schemes.

Texas Republican Rep. Ron Paul is poised to chair the House Domestic Monetary Policy Subcommittee, putting the gavel of the panel overseeing the Federal Reserve into the hands of one of the central bank's most outspoken critics.

Rep. Spencer Bachus (R-Ala.), the incoming chairman of the House Financial Services Committee, announced Thursday that Paul will head the subcommittee when Republicans assume the majority in the 112th Congress.

"This is the leadership team that crafted the first comprehensive financial reform bill to put an end to the bailouts, wind down the taxpayer funding of Fannie Mae and Freddie Mac, and enforce a strong audit of the Federal Reserve," Bachus said in a statement, adding that the committee's "first priority is to end the taxpayer funded bailout of Fannie and Freddie."

On Wednesday, a group of about 30 tea party-aligned groups wrote a letter urging Bachus and House Speaker-designate John Boehner (R-Ohio) to support Paul's bid for subcommittee chairman. The letter was in response to reports that GOP leaders were mulling ways to block Paul from becoming chairman over concerns that his views are too radical.
